My brother he is going to get married with his girlfriend UScitizen. He is overstay about 5 years already. He don't know how to start all the processing about the immigration. I feel sorry about my brother and his girlfriend. So, did anyone know how he start? And what he gonna do? I try to help him. And he didn't have much money for lawyer. So, that's why I need your guys to tell me how to do all the process. What he need to do. Thank you.

Overstay tends to be forgiven through marriage, brother needs to have an I-94 card showing when he entered the country and that entry was proper.

As long as he entered with a valid visa or VWP, he can adjust status by filing the I-130 along with the I-485 (and I-765/I-131 if he chooses to do so). Overstay and any unauthorized work is presently forgiven at AOS by marriage to a US citizen.

My husband overstayed his visa by about the same amount of time as your brother, and worked for about 3 of those years, and it was barely mentioned at the AOS interview, neither of those is a reason to deny AOS.

He needs to at least have a consultation with a qualified immigration attorney, because we do not know the specifics of his situation, but if it is as cut and dry as you make it sound, he should have very minimal difficulties adjusting status.

...and it's the law. He can adjust status based on his marriage and the overstay and unauthorized work will be forgiven.

UNBELIEVABLE, UNIMAGINABLE, UNREAL the number of illegal immigrants using marriage to a US citizen to get stay and avoid deportation while breaking the USA laws. No wonder it is so much harder on those of us that are law abiding and file properly and follow the rules and were in they USA legally in the first place, we only are punished by extended wait times and delays due to all these other cases that should have never been allowed in the first place. USCIS surely needs to know about this or better yet Congressman. Wow.

While Mr. Troll goes to Washington, in the meantime, you should definitely read over the AOS guide:

So as long as your brother was inspected by a customs/immigration officer and entered on a bona fide visa or visa waiver, he may adjust status. Usually, it would be good to seek the advice of a lawyer to get an overall assessment of his situation.

Such stunning hypocrisy. zqt3344, where do you get off complaining about other's lack of respect for the laws of the USA when you repeatedly show such complete disdain for the same? What these people are talking about doing here is in full compliance with the laws. Get over it.
