Received NTA and ready for Removal Proceedings

Hello all,

I posted this message sometimes in July

"I'm a PhD candidate in a University here in the US. I originally came to the US on an F-1 visa in 2002 but eventually met someone I like and we got married in November 2003. In 2005 I got a conditional residency. Few months after I moved up north, but my spouse really didnt like that because she is from the south. We've been having minor problems since then.She only came a few times to visit me. Few days ago, we both appeared at the Philadelphia district office and after she was called in first and spent over an hour with the immigration officer, the officer made her withdraw the petition. She denied having any knowledge of the references and lied to the immigration officer. The officer took her words against mine, and believed I was the liar since she is a "US citizen". The officer told me to expect a denial letter in the mail and I know what that means.He also suggested that I get an immigration lawyer too. I really need some help now. I am in the middle of my Ph.d program in Engineering and I have been going to school since my first day here in the US and have never been in trouble.The officer claimed all the documents I submitted were fake since my US citizen spouse denied the knowledge of all the documents. Now my references may also be in trouble as well, since my wife told the immigration officer that she doesn't know about the references."

The I-751 was denied in July, My divorce has gone through (Set) and I have hired a very experienced immigration lawyer (July). (I have been sent the NTA,after my 2nd marriage) I had to move on with my life since my ex-wife had already been showing some symptoms of craziness. However I have gone ahead and married (Oct) my gf of almost 2yrs, who is also a student here and she is 4 months pregnant with my child. We hope to go to the immigration court early next year. We have applied for a new AOS and the lawyer is very experienced. I'm glad I don't have any criminal history. My major fear is that one of my previous references wanted to get with me after she sent in the affidavit and I refused. I'm still going to school and I'm in the middle of my phd program. It has been quite tough for me, emotionally but I'm glad I'm able to put all the nightmares of my former wife before me and I can move forward.

Do I still have a chance of remaining in the country and keeping up with my life?

The lawyer kept assuring me that I will get back my status. Its just too stressful and time and money consuming. I can't work since I don't have a status. you can imagine how hard it is for my pregnant wife to be feeding me since July. Life is really hard and I don't know what my school will do in January, since I cant file for education loans without a status.

Why do you need loans, you are PhD student, surely they pay you a stipend???

As well, after being in the US for so many years, surely you have credit cards?...

Man, your social life is complicated

I don't think anyone here can reassure you in the outcome of your case - it is complicated and your description is confusing as well. You say you have a very experienced lawyer - it sounds like you have done all that could be done.

Well, you re right, I get stipends.... However, it doesnt cover the overal cost of living. Thanks for your advice.
