My wife's K-3 was approved, they gave her a hard time in Vancouver during the interview because of her visit to the U.S. and some improper paper work, as a result I flew to vancouver and when they she handed her correct paperwork in they didn't even say anything about it and just gave her the K-3. Ended up being a waste of a trip.

So my next question is what's the next step. the CR1 is still going through in Montreal. I originally thought that I wouldn't have to file an AOS and pay the fee because I thought I would get her status adjusted through the CR1. Is that still correct or am I just better off paying the money for the AOS and not worrying about the CR1 anymore?

everything is up to u, if u want consular processing ur wife will go back to montreal for her CR1 interview then if u want AOS u can do that then cancel montreal stuff, just check ur circumstances, financial wise and other stuff. please i need some more info about the hard time ur wife went through at the vancouver on her k3, especially about the improper paper work u mention a friend of my is having his interview in vancouver very soon and he is not canadian just living in canada, i just want u to eloborate what went wrong, and how u help when u flew down there, may be if his wife can go along with him it is gonna be easy. thanks

It might be cheaper to go for the CR1 interview then go through with AOS.... with the CR1 interview you will get the green card, a few weeks after you use the visa to get to the US..

Don't adjust status with the K3 and go for the CR-1.

You mayget the GC and SSN with the CR before you get it with the K3.

Also will save $1010 and a LOT of hassel.

Wish I'd done so!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If you don't mind, may I ask what the trouble was with the visit to the US? I have made a few during this process and am hoping they won't be giving me any trouble for it come interview time :unsure:

vin 75, please we need more elaboration about what ur wife went through about the visiting and the paperwork stuff at the vancouver for k3 visa, it could help prospective applicant thnaks

When my wife went in for her interview they grilled her with questions about her trips to the U.S. and were accusing her of immigration fraud. They said that she attempted to immigrate to the U.S without a visa and that she tried multiple times and then she decided afterwards to do it the right way. According to my wife the lady she got to question her was really bad and had her in tears. She tried to trap her with her questions.

They were annoyed that she didn't change her passport to reflect her name change. They asked her to sign her name on a paper she asked how she should sign it and they told her to sign it with married name. Then they proceeded to yell at her because saying she should've signed it with her maiden name because her passport wasn't changed.

She didn't have an original copy of her marriage certificate and they wouldn't process anything because of that. They told her to come back once she had that and there would be no guarantees of her recieving any visa. She had to arrange for a new marriage certificate sent to vancouver where she was staying (at a relatives) and then go back to the consulate. The consulate kept all her paperwork except passport. I decided to take off and fly up there just in case she had to go through the grilling. I'm better at handling pressure then she is. We didn't end up getting the marriage certificate until the day after they expected her back on Friday morning first thing. Nonetheless we got in handed over the passport and marriage certificate. I proceeded to ask when I would recieve it back, he said that they would mail it out as soon as it was processed probably on Monday. I asked if there was any way to get it back the same day because I would've liked to have my wife home for thanksgiving, he told us that he didn't think that was possible then took all the paperwork and told us to have a seat, 30 minutes later we were called back up and they told us that they now have everything they need and to come back at 2:15pm. So we just walked around vancouver for 5 hours and then headed back at 2:15 on the dot. This time they wouldn't let me in to the building and told us that only she was allowed in. 20 minutes later my wife comes out with a visa :dance:

I guess not having the correct paperwork for once was a blessing in disguise because if she did have it right who knows if they would have gave it to her. Thankfully my wife spent thanksgiving with me.

If I had to do it all over again I would've been there with my wife for the interview, instead of coming afterwards. I think if you have any doubt that you will be questioned about your relationship. Then you should be there with your spouse.

Still not sure why they would accuse her of immigration fraud, especially considering she isn't exactly from a "high fraud country."

Has she had previous visas before?

Anyways, I'm glad to hear that they finally granted your wife her visa, and that the two of you can now relax and enjoy your lives together :thumbs:

glad u got the visa! Not sure why they would pester her on her travels to the usa. I like many others do/did it. Congrats

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

I agree not sure why they went to all that trouble and end up giving it to her anyway. No she hasn't had any other visas's before. I hope that we don't get hassled in Montreal as well.
