Hello everyone...i just want to share my experience...

i was once petitioned as K1 last year....i recieved my fiancee visa a month after my interview but then me and my fiance didnt work for some reason serious serious coz of the delay of my visa approval so we broke up. and i decided to use the visa and so 3months after i went to USA and meet someone there and we got married but i went home last Dec 2006 b4 my K1 visa expired...now i am in CR1 visa and my interview is on Dec.19 2007.

what bothers me is that...what i am going to tell the consulat if he/she ask me why i went to USA and got married there and not my petitioner? do you think,they will not bother to ask me this question? in my passport,the old visa is still attached there? is this will give me any troubles?

please share me ur thoughts abt this!

he didnt even know that i went to USA and married someone else there.

so ur fiancee did not aware of ur k1 visa? sorry to ask did u have any family is usa and was that include in ur previous application if u have any, and how did u met ur then fiancee? sorry for all these Q. cos there some circustances that warrant someone to tell lie at the embassy. cos i have faced embassy times without number.

Tell the truth.

If you went to the USA on a K1 - BUT - went HOME after things didn't work out, then nothing is wrong. As long as YOU WENT HOME before the K1 was expired. Returning to your country without overstaying the visa was the RIGHT thing to do.

You met your new spouse, you got married, you re-filed.

I've got the same issue - my 2nd time filing a petition.

The first time, things REALLY didn't work out. I did my duty:

- Sent her home. ( Dumped the *************************************** on the side of the road in Amman. Literally. She stuck around and harassed a friend of the family ... all night ... poor guy. )

- Made sure her Visa was invalidated. ( This part was cool. I did it real slick. :ph34r: )

- Took her green card

- Reported her to DHS/DOS

- Got divorced ( It was a bit long in the process, but I came out on top. It was worth it ... that filthy *************************************** doesn't deserve the time of day. The CR green card - which I have in *my* hands - expires in a few months. That *************************************** cretin has no hopes of ever re-entering the USA, if I have anything to do with it. )

She *attempted* to come back to the USA - but was *DENIED* at the embassy. I've made them well aware of what happened - and that I took responsibility for my problem, and did the right thing.

Basically, tell the truth, and you don't have problems.

The moral of my story: Stick with someone who matches your own culture.

( This coming from an Arab who married an Arab from overseas... go figure. )

I don't have any experience with this, but I can give you my opinion? Just be completely honest with them. They will know that you had a prior petition and I would think they will ask you about it.

It is what it is, all you can do is tell the truth of what happened, I don't necessarily think it puts you in a bad light.

Anyway, I would suggest that you bring lots of proof of your marriage and relationship with your Husband, just so you are well prepared and that will help calm your nerves during your interview.

This is just my opinion but the whole thing sounds fishy to me. Things didn't work out and you still came to the US with a K1 visa without your fiancée knowing about it? Then you meet and marry someone here, get married, go back home and petition a CR1 visa?

Maybe I'm just confused but the fact that your ex-fiancée had no clue you still cashed in your K1 visa is just too weird of a situation.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

As long as you went back before the expiration, you should have no problem. HOWEVER I would have PLENTY of evidence proving the validity of the marriage. They may suspect a pattern, just have proof. They have a right to ask about ANYTHING.

It sounds to me that you entered using your K1 visa with no intent on getting married to fiance#1, true? You and fiance #1 obviously broke up before you could use the K1. I'm thinking that may cause you problems later on, because to me it sounds like you used your K1 visa incorrectly and you were here illegally. It's a good thing you did leave when you did though, because it shows good faith that you thought the K1 visa was valid. BUT, here it is all about your intent. The border patrol had no problem with you entering on a K1 and you weren't *with* fiance#1? That is very suspect.

It's odd that the CFR (8 CFR § 214.2(k)) has no mention that the alien has to certify an intention to marry the USC petitioner, and actually mentions that if you marry someone other than the petitioner while you are ALREADY in the US with a K1 then you're still considered a nonimmigrant. There is no mention of using the K1 to enter the US and THEN marry someone else. While there is no mention of that situation, I have a very strong feeling that it will be frowned upon when you are reapplying. But good luck.

I think Ladyjane and Diana have it spot on! Just reading the post looks really fishy to me. Unless I'm also not quite understanding the post? But by the sound of things, you were engaged to your fiance and broke up before you entered the US. You then still entered the US without your fiance knowing, you met someone else, got married, left the States, and then applied for your CR1/IR1 visa? That seems really fishy to me. It's like LadyJane said, it's all about your intent.. Your K1 visa was approved so you could enter the states and marry your fiance. But you weren't with your fiance anymore, and you still entered the US. You used your K1 visa under false pretences. And then you married someone else while you were in the States. I think this might really cause you problems with your interview. What did you tell the Immigration officer when you entered the States? Did you tell him that you were entering on your K1 although you're not going to marry your fiance anymore? Cause if they let you enter the country and they knew all this, then I guess you have no problem. But Im not sure if it was the case. Anyway, just adding my 2 cents worth. Many fiance/es arrive in this country and are met at the airport by the USC, which would be after they have officially entered the country, so the physical absence of the USC wouldn't raise any red flags. Whether or not it is a legal use of the K-1 visa or not, though, would be speculation on my part.

Well, if my fiance had just disappeared by cutting off contact with me after the visa was in his hands, I would not necessarily have known if he used it or not. While far fetched, I suppose it is possible.
