i130 and i485 do they both need to be filled out same time

on sept 9th 2007 my boyfriend now my husband came over on visitor visa on oct 30th we got married his i94 will expire on dec 9th we are still filling out paperwork .when i called uscis they gave me a bunch of form numbers to fill out i130 , i131,i485,i864,g325a,i765 . reading on here im a lil scared on what exactly to do cause his i94 will expire soon does this mean he has to go back to england ? and do i have to have all these filled out before dec. 9th or will he be here illegal . we didnt plan on getting married and now i feel like its a time crunch. any help would be great

Hi,

Doesn't matter if his I-94 expire if he is married to USA citizen, even if he is out of status he can still apply for permanent residence!

I was out of status and now I am in process. So don't worry about it, only you have to worry to collect all document that you need.

Go and download all the forms from uscis.gov and read carefully!!!

And YES you need to file together I-130 and I-485, and all forms that you need, everything is going in same envelope.

You do not need to have them filed before his I-94 expires as any overstay is forgiven at AOS interview... Just take your time and complete one at a time... use the guides to help you and ask as many question as you need...

There is no requirement to file I-130 and I-485 together, but it just makes more sense to do so if you're an immediate relative of a U.S. citizen...

To be able to file for adjustment of status you need to prove that you qualify via the I-130. Hence why both should be done together.
