Hi everyone,

I am in the progress of submitting my I-130 for the very first time. Visajourney.com recommends us to include the below. But my wife and I actually got married in July 2007. So we do not have number 1, 2, 3, 4. For number 5, It's hard for me to get. What about number 6? What kind of document are they? Please give me some examples with your experience.

Note: Evidence of a Bonfide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

I didn't send any of the above mentioned documents for the same reason as yours and my 1-130 got approved without any problem. At that time I didn't even know this website.

The only thing I sent was the marriage certificate.I guess you do have your marriage certificate(in English) from the government. Marriage certificate is required for cr-1. Not sure about the other documents.

Let's hear from other VJ'ers if anyone got RFEd for not submitting them.

sorry I didn't see you are filing for K3. I don't have experience on K3.

One thing, I recommend you go for CR-1. It is way better than k3. I heard the same thing from mnay other people.

This question comes up often here on the forums.

The I-130 is used for both immigration spouse visa and for AOS (after your in the USA and lived together married for years). So the list is fairly broad anf general to cover both of these circumstances.

I married in May, 2007 and filed my I-130 end of May.

The same as you, I had very few things I could file to "prove" the relationship.

The general consensus is that you file your wedding certificate, and any other things you can do.

You can (and should) assign your spouse as beneficiary on your insurance.

You can add her name to your will.

Perhaps other things.

I submitted mine with just our marriage certificate, copies of life insurance policies where she is the beneficiary, and copies of my work insurance where she is the beneficiary.

My I-130 was approved by uscis this way, so I think that is enough for the petition.

I do think though that use newlywed I-130 folks need to be prepared for the interview.

What they want to know is that it is a real marriage.

So, keep a record of mail and gifts you send to each other (keep the postage stamped envelop as it is proof of the date you mailed it).

Keep receipts for your wedding rings, and other things that might help "prove" a real relationship.

Keep emails you send to each other.

Keep a record printed out from the phone company of calls you make to each other.

Keep tickets from your travel to visit each other.

Keep pictures of you together, and pictures with your new extended families.

At the interview, if a question about your relationship comes up, you need to have enough evidence to convince them you are really in love, and not just doing this to evade the immigration laws. For people in love with each other it is unbelievable that someone would stoop so low as to marry just to get a green card, but it happens.

If you read thes forums for a while you will read of terrible cases where someone marries a US citizen, comes to the USA, acts like their spouse and lover for 2 years. Once they get the 10 year green card, the divorce their spouse and pursue their original plan.

It is terrible, but it happens, and this is what the immigration people want to make sure is NOT happening for you.

We sent our I-130 in late March and included the G-325 for each, certified birth certificates, my divorce decrees, police clearance for my wife and a few pictures from our wedding and with her family. We had no requests for further info. I do understand that when it comes time to Adjust Status that we will need to show we have an ongoing relationship with items like co-ownership of a home or a lease with both names on it, joint bank accounts and that sort of thing. You can get some good information a www.USCIS.gov.
