Hi all,

Thanks for assisting me in this process, I really appreciat all your response to my questions even though the may seem like they are :wacko: .

After waiting for a week I finally got my NOA1 on April 13 after sending out the petition on April 3, 2006.

I have the I129F documents copied and ready to be sent to the P.O Box , but before I sent it off I stop by to check on the check to see if it had cash for the I130. Well to my surprise my bank told me that a freeze was out on my account and the check was not cashed due to that (the freeze makes my cash unavailable to me). My question to you is

1. Can I still go ahead and send out the I129F even though the check was not honored?

I really want to send off the I129F and when the check is return I will pay the $30 plus the $190 fee for the petition or I can't do it like that? Has anyone ever been in this situation? Please help me out.

Do you think I will be getting a denied on the I130 or I will get an RFE. I really need someone to help me out with this . :help::help::help::help:

I think your best bet is to speak to the bank manager and get your account clear. I do not think you can do the I-129F the way you have suggested. Sorry.

Are you saying that you wrote a hot check to the USCIS for an I30, and asking if you can write them another hot check for an I129?

I must have read this wrong. Surely nobody can think this way.

how did your account get frozen? was it one of those security check things?

I used money orders it works my nerve waiting for checks to clear.

I refuse to use checks..

Thank you all for your comments. I really wanted to know if I could use the NOA1 that I had recieved to file the I129f thanks for clearing that up.

No it was not a security check that froze my account, a stupid debt collector figured they weren't getting paid fast enough so they froze my account ( the good thing is they couldn't just take my money out).

I got in touch wit hthem they got a good piece of my mind and the bank is gonna unfreeze my account the thing is it takes 48 hours so I have to wait until Wednesday.

I am not sending no more checks- from now on I will only be using money orders. First thing Thursday mornig I am gonna go and get two money orders one for $190 and the other for $30.

If you had read the post you would have seen that I had more than sufficient money to post that check in the first place. It was not until this morning that the freeze was put on my account. Do you think I would be so inconsiderate as to send a check to the govenment knowing full well that I cannot pay for it. That is ludacris, this is my husbands well being. I sent the check knowing that I had more than enough in either of my accounts. I am not a cheater you really read the post incorrectly. Why is it that everyone saw that it was a mishap but you had to think I 'wrote a hot check' . Writing 'hot checks' is not something I would do and furthermore when it comes to the government (USCIS, IRS) I ain't stupid enough to mess around and write a 'hot check'. :no::no:

I am sorry if you took offense to my comments. I have read your original post several times and see no mention of multiple bank accounts with loads of money in them. We will chalk this one up to language barriers and ignorance on my part. Sorry!!!

I have a few rental properties and every time somebody writes me a hot check they try to blame the bank or say they have some sort of freeze on their account that they did not know about. Most people blame the IRS! Sorry I let my real life experience influence my internet advice!

That is ok, but it is the truth. I got a little heated about that because I felt you were judging me. I too will chalked it up to a misunderstandin through communication and move on. Ain't it funny how one person will say something with mo intention of offenind the other but no matter what communication on the internet can be mistaken to mean other things.

Well, just a heads up I have been touched numerous times but stillno letter from Homeland security or USCIS. I am really getting impatient and want to send out my I129f . I spoke to a represenative via the USCIS hotline and even though the first one I spoke to informed me that I could go ahead and mail the I129F I did not do it. The second one told be it is best to wait until I get a return letter about the payment,in hopes that if Isend outthe I129F it does not get denied due to unpayment of the I130.

In all retrospect I really want to mail the I129F, I know in the get go the opinion of those on here was to wait but I am so impatient do you think I could use the NAO1 I have and send off the I129F ( with Money order)? :help:

I think you only need to wait till the check clears your bank. You don't get anything from USCIS after the NOA1 until you are RFE'd, approved, or denied. There will be no letter to confirm that they have been paid.

Was the check returned to USCIS or was it simply put on hold until the account was restored?

I also suspect that the person at USCIS was correct. If I were you I would probably file the I 129 with a money order.

I never thought ot ask teh bank if they are holding it or if they returned the check. I guess I will wait until Monday to call the bank and find out.

You dont think they will deny the I129F because the I130 was not paid ? The USCIS should be sending me a letter requesting payment, right? I dont think that they would try to process it without payment- I really hope they dont try to .

We can all only guess about what they will do if the bank returned the check to them. I don't remember a case where this has happened here. Hopefully the bank will tell you on Monday that the check has cleared and USCIS has been paid.

There have been many cases where people sent the worng amount. In those cases the USCIS sends the entire package back. This happens before the NOA is sent. In your case I don't have a clue what they will do if the check has been returned to them. Perhaps they will just run it through the bank again. We can only guess about this.

hiya...right sorry to hear about your circumstances. hopefully this may help and i dont think anyone has thought of this, but in my past experiences with banks, if a check has been denied once for insufficient funds, the bank typically runs it through again. Checks when denied the first time are run through again. Because the account has been frozen, it will be upto you to call the bank and speak to them about what happens when accounts are frozen. I would think that because it wasnt a matter of insufficient funds, it would be cleared up without any penalties. Just call the bank asap and find out.
