Another pig abuses the taser.. kid tasered for not signing a speeding ticket

The guy had a couple chances to avoid being tasered. Sign the ticket and if he knew he didn't want to sign it, just do as the officer said. Instead HE himself put him and the officer in a dangerous situation. I know this guy knew better than to walk away from the officer, but he did and he unfortunately suffered the conquences.

It appears the officer lost control of the situation when he asked the driver to step out of the car and then walked away from the driver. (not a good move by the officer)

The officer ... by law ... had the requirement to inform the driver that he was being placed under arrest (intention, cause, and authority to arrest him) and could have done so in a safe manner. The officer could just as easily have informed the driver he was under arrest when he requested the driver to step out of the car.

It was handled very poorly.

No, if a civilian tasers you for no reason it's probably not OK to shoot them.

Makes sense. How about taser them back?

The thing is, I have yet to see a recorded case where an officer "tasers someone for no reason." Like a cop walking by a civilian on the street, doesn't like the way they look, takes out the taser and shoots them with it. There is always some sort of provocation. Whether the response was the correct force to use in the situation is a controversial and debatable subject...but to say there was "no reason," as if the cop just decided to taser someone for fun and not to facilitate some sort of law enforcement goal, is a bit unfair. I would say of all the internet videos I've seen that claim irresponsible use of a taser, this one comes closest, but there was still a reason. The cop said he looked like he was leaving and the way I personally would have articulated it, based on considerations of scenarios that could unfold, is that I thought he was going to the car to get a weapon. Still, I don't see why he didn't just handcuff the guy to begin with.

It's Utah law .... the officer had the opportunity to inform ... and did not do so before escalation.

Utah Code Section 77-7-6

77-7-6. Manner of making arrest.

(1) The person making the arrest shall inform the person being arrested of his intention, cause, and authority to arrest him. Such notice shall not be required when:

( a ) there is reason to believe the notice will endanger the life or safety of the officer or another person or will likely enable the party being arrested to escape;

( b ) the person being arrested is actually engaged in the commission of, or an attempt to commit, an offense; or

( c ) the person being arrested is pursued immediately after the commission of an offense or an escape.

Not sure if he was worried about it, but that would be my reasoning for such use of force. You're right, tactically that was a very bad move, turning his back to the guy after taking him out of the vehicle to arrest him. There is definitely some grounds for retraining here, not everyone is perfect like me :dance: *just kidding obviously*

Not sure if he was worried about it, but that would be my reasoning for such use of force. All but the speeding charges have been dropped and lawyers will get rich ...
