Hi Guys!

I'm new to this website and i find all the informations here are very helpful.

Anyway, here's my situation last 2004 my husband filed my AOS and the INS lost all the papers and so we resend it again by 2005. After 4 months i've got my temporary green card without any interview. I was very happy that finally i feel legal here in the US. My temporary green card will expired next year January of 2008.

To make the story short, I am ready to file for my ten years green card and I just found out this month that my year of residency in my temporary green card is WRONG. It said there that EXPIRED: 01/23/08...RESIDENCE SINCE: 01/23/06 when I arrived here last April 2004. I really don't have any idea that the date of my residency is wrong until now. I don't know what to do? Obviously, this is INS error. Shall I file for I-90? How long does it take? :help::help::help:

Anybody that has the same case with mine please advise me on what to do. I only have 2 months left before my temporary green card will expired.

Your "resident since" date isn't the date you arrive in the US but the date your adjustment of status (AOS) was granted. You mentioned you remailed AOS in 2005 and it was approved 4 months later....when exactly did you remail it and when was AOS actually approved? If you mailed it later in 2005 (around September?) and AOS was approved in January '06 then the date is correct and there is no error. If your card isn't expiring until January '08 then it sounds as if you were granted a 2-year Conditional Permanent Resident card, as is normal to receive if you were married less than 2 years when AOS was approved.

i dont see any error on ur residency, it starts counting from the day u re granted ur conditional green card or the day they order the porduction of ur first green card, which i guess it was january 2006. so go ahead with ur lifting of conditional green card.no problem

PJ...you're the best! You really make my day today. I do have my records of when exactly i remailed my documents but i just can't wait to tell you how much thankful I am for answering my questions. Thank you very much...i appreciate that.

Thanks a lot Jeje...now am at ease and i will go ahead and send my application for 10 years gc and hopefully it won't take long for them to process as i am planning to go home in Philippines July of next year.

You're welcome! Once you submit your I-751 and the check is cashed, you should receive the NOA within a month or two that extends your Green Card for another year. This NOA, along with your expired green card, will allow you to travel outside the US and re-enter in the event you don't receive your 10-year GC before you leave. After the NOA is issued, you will also receive an appointment for another biometrics but the date scheduled depends on your local area.
