Our I-130 & I-129F were approved on the same day, Oct.12th however, only the I-129F was forwarded to the NVC. The I-130 NOA2 stated that my husband was in the US and was going to adjust status...not true, he's in England. What would have given them that idea? Are they just too busy and not paying attention or do they want more money from me having to now file an I-824? My attorney sent them a letter asking for them to foward the approval to NVC because of their error without us filing the I-824. He told them that our I-130 clearly stated where he was living.

Has anyone else experienced this mistake?

I'm very upset with this delay especially since it took them 6 1/2 months to appove the I-130.

Turned down at interview due to criminal past & US overstay.

5/21/08 I-601 waiver received in London

6/9/08 Appeared on the "Status of I-601 Applications" list (they said "up to 15 weeks")

11/10/08 Moved up to "Under Review" after 21 weeks

11/19/08 Case Completed - Denied

8/5/09 Moved to England to join my husband and wait out his 10 yr. ban and reapply.

here is the thing, once u file i-130 and later file i-129f for k3 or u file it together uscis automatically believe that u re going through k3 route, once the both petition re approve together they hold the i-130 and forward the i-129f to nvc for k3, even when i-130 is approved first they hold it for i-129f to be approved somtimes and sent it to nvc. then the i-130 will be held at uscis for ur spouse to come to states to AOS, then if u later want to go for i-130 u have to file i-824, which take several month to be approved, then ur i-130 will go on, am sure ur spouse will have been states by then doing AOS, i would have adviced u to just stick by ur i-129 and go for k3.

You are talking about 1 month.

You need to understand this is a long slow process for the k-3 or I130.

They will move forward on it. Just hang in there and have faith.

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

hi,

USCIS in their advisory have clearly stated they have got double cases this year from 1.2 million to 2.5 million. thats why they are expereincing systematic delays because they dont have the personnel to do processing work. Hang in their they will do all the stuff.Tell your lawyer to be in touch, and you be in touch with NVC through the live operator.

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Well, I called the NVC today to check on the status of my approved I-129F and they said info. was forwarded to London on Nov. 7th...ok that's good.

I then asked if they had anything on my approved I-130 and of course they did not, she told me to check again with USCIS. So, I gave them a call and after explaining several times that the USCIS office made a mistake on my I-130 NOA, I was forwarded to another customer service person who listened to my story and said that if my petition clearly stated that my husband is not living in the US then it was their error and they would agree to forward it to the NVC without me having to file an I-824 and pay over $300. But it will take several more weeks for them to resolve it...no kidding we all know nothing moves fast with the government.

I'm releaved that it won't cost me additional money to file the I-824 to correct their error. That was a big issue for me, it wasn't my mistake so why should I pay to file more paperwork. I'll be on this like a hawk, calling back in a few more weeks if I don't hear anything from them.
