Confusion about getting SSN

My fiancee arrived Tuesday and I rang up the SSA about getting her a card. They told me she's not allowed one unless she has proof that she can work here. Is this true?

Since she came in on the K1 fiancee, we have to apply for an EAD and that is taking 11-12 weeks now. Should she just file for a tax ID now? I have to provide something to add her to my bank accounts, and for taxes this year.

Thanks

Print of the document from this link https://secure.ssa.gov/apps10/poms.nsf/lnx/0100203500#C1 and point out section C1 to them which states that a K-1 Visa is work authorised.

The following sections list nonimmigrants, by alien class of admission codes, who are authorized to work in the U.S. without specific authorization from DHS. The person’s I-94 will not have the DHS employment authorization stamp and the alien will generally not have an EAD.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

Not sure of where you bank, but talk to the bank manager and explain your situation. Given that the bank has to produce a document as part of the K-1 process, they can be surprisingly understanding. In my case, my fiancee (now wife) had no documents other than her passport and the K-1 visa. Bank of America agreed to let her open an account with me on the condition that she return after she had some form of US ID. Didn't hurt that I had banked with them for 20 years. After our wedding, she was able to get a Virginia photo ID and we took that to the bank to add to our file with no problem.

As far as the SSN, I suspect that you will be waiting until the EAD comes through. In my wife's case, the two actually arrived on the same day, even though they had been filed at different times. But she had to sit at home for six months before that happened.

Good luck!
