EAD renewal- trying to find the right "timing"

WHen is that latest possible time to apply for an renewal EAD?

I know you have to file within three months before the expiration date, but is there a cutoff date that you can't file after?

My EAD expires Feb 26 2008, how long could I wait with filing?

Usually I would just file in December, but I kinda hope I will get my interview before it expires.

And lets say, I have my interview before it expires and I get approved, but I don't have my greencard in hand by the time it expires, what then (my emplyer will ask for something) ?

In that case, would I have to ask them to stamp my passport, how does that work?

Was anyone in that kind of situation?

Usually I wouldn't mind to just file for renewal regardless, but the $340 is a lot of money and I bet, I file and within a month or so i have my greencard. That would be typical for me..lol

Does anyone have some advice for me please?

Howdy

There isn't a cutoff date after which you can't file, but because EADs typically take three months to process, it's advisable to send in your application about 100 days (some suggest 120 days) before your current EAD expires, which in your case is now. This is to avoid a possible gap in your employment authorization. If you wait too long and face a gap between EADs, the local office can't help you, and they won't give you a stamp. We ran into this last year. Hoping that my husband's green card would arrive before his EAD expired, we waited a bit too long to apply for the renewal, and he faced a gap of a few weeks. Fortunately, his employer never asked for anything, but it was very stressful. Also, his license expired on the same day as the EAD, so he was driving without a state license during that time (also stressful!). When he went to the local office to see if anyone would help him, he was told that they couldn't do anything because it hadn't been 90 days since the NOA, and it was his own fault for not applying earlier. Regarding employment, the burden is on the employer to make sure you have current docs. Some companies keep track of this stuff and may ask for a current EAD, others don't.

I understand the quandary of not wanting to fork over the $340 if you think you may get your GC before your current EAD expires. What was the purpose of your 11/17 fingerprinting appointment? Do you have reason to believe that your GC is imminent? Do you know what's holding up your application? If not, I suggest biting the bullet and applying for the renewal EAD now. We're looking at applying for my husband's third EAD in another couple of weeks (his expires in March 2008). Yes, the GC could arrive before then, but we learned our lesson last year!

September 20, 2005: K-1 Interview in London. Visa received shortly thereafter.

May 5, 2006: Interview at Phoenix district office. Approval pending FBI background check clearance. AOS finally approved almost two years later: February 14, 2008.

Received 10-year green card February 28, 2008

You should file now for the renewal or you run the risk of not getting the new one in time and then you would have a gap.... if your employer is anything like mine they sent me a memo 1 week before my greencard expired asking me to provide evidence that I am still allowed to work....

Yikes, the hold up on your GC is due to FBI checks? You must be completely fed up with the wait!

Yes, it's a real drag. But our two-year anniversary is coming up, so when the namecheck finally clears, my husband should be issued a 10-year card (i.e., no lifting conditions). But it has been a frustrating and expensive exercise! Especially now that fees for AP and EAD have doubled.

Do you have reason to believe that your GC is imminent? Do you know what's holding up your application? If not, I suggest biting the bullet and applying for the renewal EAD now. We're looking at applying for my husband's third EAD in another couple of weeks (his expires in March 2008). Yes, the GC could arrive before then, but we learned our lesson last year!

My second biometrics appointment was a routine thing I was told. I asked the guy who took my fingerprints and he said, they do that every 15 months during the AOS process. Well, it has been only 11 months since my initial appointment but oh well.

My case was transfered to CSC and back to a local office and I assume it is New Orleans, but I am not sure.

Accorning to the online rocessing times, NO is processing cases from november and I filed december, so I hope, I am getting close. I heard, they are pretty good in catching up on applications and I hope, mine will be processed really soon as well.

That's why I am a little hesitent to spend the $340 on the EAD but you all are right, I guess I have to...since you never know, what else they have in store for you...*sigh*

You were misinformed about that second set of prints. They don't 'routinely' take prints every 15 months - they let them expire and don't ask for them again until they are ready to issue a greencard.

It's odd you would be asked for a second set at this point. UNLESS there was a problem with the first set. Occasionally a set of prints is 'unreadable' and they must ask for a 're-do'.

In my opinion it's hard to say what this set was for - they could be ready to issue your greencard now or maybe not.

Personally, I'd be tempted to make a call to the misinformation line and see if they can shed some light on your I485 petition. The person who took your prints wasn't forthcoming with you.

Yeah, I thought his explanation was odd too. I don't think anything was wrong with my fist set, since they used those for my fist EAD already.

THis second appointment came shortly after my case was moved to the local office after 10 months at CSC. That's why I think, something might happen soon, at least getting my intrview appointment.

That's why I was asking about te EAD renewal.

I remeber though, when they took my prints the first time, they guy had a hard time to get them done right without having "matches".

What happened was, he scaned the finger and a red window came up on the screen, saying they found x-amount of matching prints. so he had to do it over and over again until every print was "clear". Maybe there was still a problem but it seems odd to me that they still used the prints for my EAD.

Oh well, we will see.
