Timeline

Hello everyone,

How does getting a SScard work for K1visa holders. Do you have to apply for EAD before a SScard can be issued? When my fiance first came we went to the SS office to apply for a card. That was on 10/16/07 and we have yet to receive a card. We went back today and they said that department of homeland and security has not verified the document yet. #######!!! When I called USCIS they were saying that we needed to get married first then apply for EAD and permanent status before a SScard can be issued. I'm cofusued. Please help!!

Timeline

K-1 is "Work Authorized" SSA will issue a SSN, during the 90 days of the I-94. It takes 2 weeks or so for USCIS to record K-1 entry, so visiting SSA office before then usually results in no SSN, also SSA wont issue SSN within 2 weeks of I-94 Expire.

What USCIS told you is wrong, that line is known as the misinformation line.

We applied for SSN just after marriage using K-1, I-94, and Marriage cert (For name change).

Marlon and I went the DAY before we got married and we are lucky we did because if you file after marriage it is NO LONGER a K1, you will need to file as a K3. That's what the lasy told us. Look into that hun! All we brought was his JA DL and passport.

I took Claudeth to SSA two weeks after she arrived and she received the card about a week later. We had to show something official from the USCIS to change her name on the card and that took six weeks to get the new card.

The above is totally wrong... your status does not change when you get married and no you are still a K1 visa holder until you file for AOS....

A K1 visa holder can apply for a SSN from the day they enter the US up to about 2 weeks before the date on their I-94 card.... if you do not file for a SSN before that time then you will need to wait until you have either a EAD or your Greencard and once your K1 Status expires (90 days after entry) you are no longer employment authorized and you do not need a SSN... so you have to wait until you are employment authorized again when you get approved for the EAD or the Greencard...

If you search around the VJ guidelines you can find a copy of the Social Security Admin letter ruling dealing with K-1 applicants and saying that the I-94 makes them work authorized and they are to be issued a SS #.

I made sure my fiancee came in through JFK so she would get the Work stamp to make it easier since I had so many problems getting one for my former fiancee (in her case she stayed 89 days and a month after she returned to Russia the ss office called and were about getting ready to process it.

The problem for me and some others is in out of the way dinky places that don't deal with many k-1's the SS people are at a loss for how to process them.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.

3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

RM 00203.500 C1 is what authorizes a K-1 to be assigned a work authorized SSN based on the I-94 showing current K-1 status. The work stamp on the I-94 isn't going to make getting an SSN any easier for a K-1, since only the I-94 is needed.

Hello everyone,

When I called USCIS they were saying that we needed to get married first then apply for EAD and permanent status before a SScard can be issued. I'm cofusued.

Don't take SSN advice from immigration and don't take work authorization or tax advice from SSA and you will be less confused.

Thanks everyone. I don't understand what is going on with the processing of his SS# It really should not be taking this long. I have called USCIS and everyone and no one is giving us a straight answer. What I think I am going to do is apply at another local office. I am just so frustrated because everyone else got there card in 2 weeks.

We went back to the SS office for a third time and they said that the office was backed up from all of the October applicants and that he should receive it in about 7-10 business days. I actually saw her write cleared on the paperwork so I am hoping that he will have it soon. Ohhh goodness what a process. Thanks again for you advice.

If the application was cleared today he should be able to go back to the office tomorrow to find out the number.

That's what I had to do because it took so long for them to send me the card. You can go back in a few days (it depends on what day the SSN are generated) and then they an look up your number and give you a printout. You can use that until the card arrives and at least you have a SSN.
