Hello Everyone, on the I-864 it ask for 3 years of W2 and Taxes, but I have been reading that you only need one year. Which one is the correct answer? How many years did you guys submit.. Any help would be great.

08/18/06 Receipt date for I-485, I-130 and I-765

08/24/06 NOA1 I-485, I-130, and I-756

08/29/06 Receive Biometric letter in mail

08/31/06 I-130 Touch

09/05/06 Biometric appointment (everything when okay)

09/05/06 Receive Interview letter for I-485 in the mail for 10/17

09/06/06 I-485, I-130 and I-765 touch

10/17/06 Interview day (interviewer did not have my permanent file)

10/17/06 I-130 and I-485 touch

10/17/06 I-130 Approval e-mail

10/18/06 I-130 and I-485 touch

10/19/06 I-130 and I-485 touch

10/20/06 Receive I-130 approval letter in the mail

11/20/06 Call 1-800 regarding my I-765 beyond processing time

11/25/06 Got letter about change of address and I-765 beyond processing time

11/28/06 I-485-Welcome Letter e-mail :), I-130 touch

11/29/06 I-485, I-130 and I-765 touch

11/30/06 I-485-E-mail- Card production ordered :)

12/01/06 I-765 Approve LOL, card production orderd

12/02/06 Receive Welcome letter in the mail

12/05/06 E-mail- I-765 Approval notice sent and I-485 Approval notice sent

12/06/06 EAD card finally came in the mail I-485 and I-765 touch

Yes on the w-2s. Only needed if you filed jointly to prove your portion of the return.

The I-864 instructions (page 2) wants a copy of your tax return for the past 3 years.

Definitely only 1 year is now required.

If you search in the Immigration News forum, somebosy posted a copy of an internal USCIS memorandum that states this.

If they need more, it says they can RFE for them, but the last years is all that is needed initially.

Could you please tell me WHERE the Consulate is even involved here?

By definition, the location for AOS is inside the US, never at a consulate.

I thought so too about the W2's from reading the instructions. I got RFE'd for my W2s.

Really? Weird...

Yes. The RFE clearly stated that W2s are part of the required evidence.

It's definitely not clear from the I-864 instructions. They should really change the wording to what they intend.

IR-1/CR-1 process is one instance...technically it's not AOS, but it requires the I-864 and results in a greencard. /shrug it requires a tiny bit of a stretch beyond the concrete barriers of this forum's topic, but that's probably what he meant. My apologies to Boiler if I mis-spoke.

Also, unless you live in the areas that were affected by Katrina (those people got automatic extensions), the tax return required will be the 2005 return.
