Timeline

After reading posts from people here (saying that you can and what to do), I've decided that I'm going to try and visit my fiance for 6 weeks. Unfortunately, school just ended and I left my job (as far as proof) - I have to go in for surgery mid June so I'm trying to get that paperwork together as proof of my return to Canada (as well as a statement from my parents health insurance, being that I am still covered by them).

Any ideas for additional proof?

Also, my fiance took a bag of my clothes over this weekend to help lighten the load for when I come over and he was subsequently searched because of it (land based border). He said the border guards were really nice about it, they only took like 5 mins to search the truck - he told them that we had every intention of immigrating legally, about the lawyer etc But.... they did ask for MY name and birthdate, could that mean I'm flagged already?

I'm also kinda stuck about what to say when they ask what's my purpose for traveling to the US, any ideas?

I will be honest with you.My wife is also Canadian and tried to cross into Buffalo NY to catch a flight to come see me.At the time she was my fiance and we had already sent off for her K1 etc.The pettion was already in Montreal.She was stopped at the POE and had one hell(she was held for over 3 hours) of a time.She was turned around and sent back.She was also told that because we had applied for a K1 visa that she could not visit the US untill it was approved.He told her he could of gave her a 5 year ban.That really scared the hell out of us.When she went for her inerview in Montreal the officer new everthing and asked her about it.Once you are waiting for a K1 they think you are trying to move here and just marry.Im not telling you this to scare you or upset you.But if I was you I would 100% not try and come to the USA.From my understanding you are not suppose to visit while waiting for a K1.I know others will tell you different,but im telling you from experiance.Yes I would say you were flagged if they asked for all your information.They will see your K1 pettion in there computers.

yikes! i'm sorry to hear about your troubles! i've crossed over at lewiston about 6x since my application has been sent. 2x for me to fly out and the rest to pick up the boy. never had any troubles although i got a bit nervous the last time taking him back for his return flight when the guy seemed to be typing a lot into his computer, but it was all ok. but now i'm nervous about doing it again...especially since i've turned in packet 3...

yeah that's what I'm scared about too. We had a lawyer for the beginning of our paperwork and HE said while they don't like people entering the states, there is no rule forbidding it - it's all to the discretion of the border agent. I'm not planning on making this a regular thing, just this once as a visit.

Take all your proof that you have to be back in Canada for the operation. when they ask why you're visiting be honest - you want to visit your fiance before you have your operation. They might let you through or they might not, but the only way to find out is to try! At least you have the advantage of geographical closeness - you can drive to the border and you don't need to buy a two thousand dollar plane ticket to get there! I never tried to visit because the risk was too great to be worth it...

BTW they wouldn't ban you just for trying to visit... but they have a high likelihood of saying 'no you can't come back until you have your visa in hand.

It's also worth taking all paperwork from USCIS to prove that you have filed the application and fully intend to see the visa through.

Print out your transcripts from your previous semesters if you are returning to school in the fall, or a prof you can contact about your return. A note from even your GP about your upcoming surgery would help also. Do you have cell phone bills or a contract with a cellular provider? Anything that shows you still have ties to Canada will help. I know how apprehensive boarder crossing can be. Remember be honest! Good luck.
