My husband and I have just recieved the first NOAs for his CR1/IR1 Visa, Application of Status and EAD. None the less we are planning ahead for the eventual process for pursueing citizenship as well. My question is this... since we have only been married 3 months he will recieve Conditional Permanent Residence Status until 8/18/09. In terms of applying for citizenship it appears he can apply 90 days before he's been a permanent resident for 3 years. DOES this time include when he was a conditional permanent resident or when he the restrictions were lifted?

Three years of "Residency" makes no difference conditional or not.

05/03/07 - NOA2

05/10/07 - NVC receives petition, case # assigned

08/08/07 - Case Complete

09/27/07 - Interview, visa granted

10/02/07 - POE

11/16/07 - Received green card and Welcome to America letter in the mail

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

where is the official evidence on this on USCIS? I can't find it anywhere.

7/23/07 We receive NOA, in receipt for applying for lifting of Conditional Status.

8/2/07 Receive appointment for Biometrics (for 8/22)

8/29/07 Receive RFE notice

11/12/07 Submitted additional evidence to comply with RFE

12/29/07 e-mail from USCIS: Card production ordered

1/4/08 card received in mail

It starts from the very first day when one is granted a conditional permanent resident card.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

thanks Caro, but I had already read that section in USCIS, and nowhere in there does it mention "Conditional" Status, so it is confusing.

thanks simple male, hope you and others are right, it would mean my wife is eligible this September, even though she received her 10 year green card yesterday.

it says you have to be a permanent resident for 3 years...

and you are a permanent resident regardless if your green card is conditional or not...

and you are a permanent resident regardless if your green card is conditional or not...

thanks, that's what I thought when I read it on USCIS website, but was not sure.

Think about it another way... When you arrive at a POE there is a line for visitors and a line for US Citizens and permanent residents... No where do they make a distinction between conditional and not conditional residents... permanent residencey is just that....

that is true, but in researching the USCIS website, things are not always clear.
