:ot: So those of you who were married and filed for K3 or CR1 how did you handle your taxes when your husband or wife was still in Jamaica. Can I list hubby on my return or does he need to have a social security number. How does this work when you are married but your spouse lives out of the country?

Mar, I never put my husband on my taxes I didn't know I could have done that until I got on this site..this year will be the 1st year I file for him as a dependent...

I am now feeling the pains of having filed my taxes and not adding the hubby to the returns. I wished I knew this before as well. I am now adjusting my 2006 taxes to change my filing status so that he can be awarded financial aid for school. I should have the amended taxes done soon, it's being held up as I am including his income and taxes from Jamaica in the return; yes, it can be done. I spoke to the IRS 2 times already about this and they say it can be done for a joint return. I'll be accounting for his income and taxes in our 2007 tax return.

I received an extra thousand dollars for filing jointly when my hubby arrived it was worth it and it paid for much of the CR1 process which helped out a lot. Best wishes if you need any more info let me know.

$1000! Thats what I'm talking about! With owning a house and having a husband I shouldn't have to pay taxes during the work year at all! I should be getting apretty penny back cause these visa fees are gonna start piling up I'm sure.

Kimmy. I think you can file back taxes to claim that extra money on your hubby. Not too sure, but you can go to HR Block or TurboTax.com and get info on this there.

You can Kimmy; it's a 1040X form that you can get through the irs website (www.irs.gov). I am doing that right now and it is working out for >$1000 in a refund for 2006! You can amend your returns up to 3 years after they were originally filed.

Do I have to include my husbands income in my taxes for 2007? Or do I just list him as a dependent?

In my conversation with the IRS agent, if I am filing jointly, then we are electing for him to be treated as a resident though he was not a LPR at the time. If he is treated as a resident, then worldwide income is subject to US taxes. Don't worry they won't tax his income, but you can use the taxes that he paid in Jamaica as a credit. Honestly, it is a long convoluted process, so I would just claim him as a dependent. You have to file additional forms if you go the foreign income credit route. So the short answer, no you don't have to use his income.
