Are the funds paid to USCIS to bring someone into the US on a K-1 visa tax deductible? What about the AOS fees?

Be sure the person you are bring into the country receives an I-94. Ours expired by the time we had it replaced. SS will not issue a number on an expired I-94. So I will have to file a Form W-7 with my federal return this year. My wife will not have her SS number by the time I'm ready to file our taxes.

AOS Journey:

30-Aug-2007 Arrived in US!!!

27-Nov-2007 Married

23-Jan-2008 Mailed AOS package

25-Jan-2008 AOS package received in Chicago

1-Feb-2008 Checks cashed

4-Feb-2008 received NOA for I-485 & I-765 in the mail

22-Feb-2008 Biometrics Appointment

31-Mar-2008 EAD Card Production

5-Apr-2008 Received EAD in mail

8-Apr-2008 Applied for SS

19-May-2008 SS card arrived in mail

19-May-2008 AOS approval arrived in mail

Ladies,

HAPPY NEW YEARS!!!!!!!!I have not been on in a while, but i wanted to dropp in to see how everyone was doing? As I can see there is not alot of the oldies from 2005 left on here, iI hope it is because everything is going well. Fromm personal experience it is probably because there spouse is a pain in the a..!!!!!!

For those they don't know me I married me spouse in April 2006, if he is lucky I may stick around to remove his conditions in the summer, but at this rate I wish he would find his own way in this country, cuase I am tiredof all the bull..... You may understand whre I am coming from if you are dealing with someone 5 yrs younger, and thinks that he knows everything about how to get by in this country.

If there is anyone that is dealing with a similar pain, please pm me, i need to talk with someone that can relate to this.

I remember you, Suzy! Welcome back! Good to hear from you. I changed my screen name but I was around back then. Sorry you and your hubby aren't having the best of luck in the marriage right now. I can relate - I sent you a PM :)

Sorry, Jay. No they are not tax deductible. Wish they were. If you were to adopt from Jamaica, you would get some tax credits. Otherwise, nope. Not the AOS fees either.

I was just going to say the same thing...not tax deductible...sorry.

If you don't want to file the W7 you could always file an extension until she gets here soc card. We filed the W7 but it took forever and we never got a number. So I just waited until he had a soc number and then sent our taxes in. Like the ladies said no tax deductible for the visa.

I filed an extension on my taxes and waited for my hubby to get here. Then filed when he had a soc number. I also filled the W-7 form but it took forever to get a number. You can do that but you will need a notarized copy of his passport information. So if you dont know a notary from your state you will need to get his passport and have a copy of it. They have to see the real passport to sign it. I knew someone who was a notary so the passport was not necessary. When do you think your husband might arrive? If its sometime this year you will be fine with an extension especially if you don't owe on your taxes.

For dependents not eligible for a Social Security number, you must apply for an Individual Taxpayer Identification Number (ITIN). Complete Form W-7 and submit along with the required supporting documents to the Austin IRS Office. Completed forms W-7(s) and supporting documents are then included with your tax return. ITIN numbers are for tax filing purposes only.

Mar, I never put my husband on my taxes I didn't know I could have done that until I got on this site..this year will be the 1st year I file for him as a dependent...

Hey Suzy, I don't remember you cause I wasn't around then :)..but on a more serious note truthfully i really can't say I wish I knew what u are going through b/c I know from your post it's not the best thing that could be happening to u guys right now. What I can say is that talking to others will sometimes help you heal, thru PM cause people business get around here and u don't want ppl coming back throwing stuff in ur face about when u were going thru ur rough time. Welcome back though and I can say the support system is still here even though we don't know each other. Many of the oldies still give alot of support and there are some newer members that are totally fabulous when it comes to support. like Gilli say "THIS TOO SHALL PASS"!!!

I received an extra thousand dollars for filing jointly when my hubby arrived it was worth it and it paid for much of the CR1 process which helped out a lot. Best wishes if you need any more info let me know.

$1000! Thats what I'm talking about! With owning a house and having a husband I shouldn't have to pay taxes during the work year at all! I should be getting apretty penny back cause these visa fees are gonna start piling up I'm sure.

Kimmy. I think you can file back taxes to claim that extra money on your hubby. Not too sure, but you can go to HR Block or TurboTax.com and get info on this there.
