Yes there's hope but you are going to need to file a waiver, and you're going to need legal counsel.

It's also VERY IMPORTANT as to which day EXACTLY his visa expired and which day EXACTLY he left the US. From what you have told us, he is sitting on the difference between the 3 year bar and the 10 year bar.

Has anyone here overstayed in the US but decided to go back to their country and filed for K1 visa and got approved.

Please let me know. I want some hope.

I think I have read your post from another forum. Your worries seems that you know what could be the possible outcome.

A sister of someone I knew overstayed in the U.S few years ago with a tourist visa then she went back to the Philippines voluntarily. After a year she met someone who marry and petitioned her as K3 since they got married in PI. Unfortunately during her interview last Dec 2006 she had been denied and give her back all her documents.

My Daugther's IR2 Visa Timeline

October 03 -2011- Sent the Application for I-130 Package

October 07 -Receieved USCIS acceptance of Application by e-mail

October 12 -Received Notice of Action by Mail

April 27, 2012 -Finally Petition is approved!

May 03, 2012 -Received NOA 2 in the mail
