You are way over the timeframe and your case should have a case worker - call your rep back and get your case workers name - and then call him or if the office is close to you go there and see that person. Dont rely on voice mail, they are very slow to respond to that issue, but AGAIN, they are your best chance right now....

What reason are they saying for waiting a few more weeks - I may be tired but 2006????? Hell at this point I will call them for you - blimey gits

I know :crying::crying: Don't get me started because I will cry again and be more stress!!! I did get a letter from the CIS Ombudsman yesterday(I am praying and hoping soon!!) and I am going to call my senator's office today!!! I am also writing another letter today, don't know to who, but I am!!! But then we have the long wait ahead as well after the approval... ANd I heard because my husband is from the Middle East that his paperwork might even be going to AP after everything goes through.... What Misery :crying:

Hey everyone I just go off the phone with USCIS, (yes again, my weekly call to them) and this new lady answered the phone. She advised me that the reason why K-3 visa are being cancelled in general are because the State Department are in fact all caught-up with processing I-130's and both the I-130's and K-3 visa are taking the same time to be process. And if they feel like your I-130 will be approved about the same time as your I-129F, they rather choose for you the I-130 and save both time and money. This of course was what she explained to me... She told me that NOT everyone at USCIS was aware of this process and that finally they are starting to find out the correct way the "HARD" way. Of course still no status on my case but she promised me that she would follow-up with my adjudicator and call me back… Well I am still waiting for this call from 3 weeks ago… I am still trying to be patient!!

Just thought you might want to know the latest information from the RFE line!

APPROVED!!!!!!!!!! My Congressmans office called me with the good news today. In less than a week they have got things moving, and will follow it through to the interview date. They have infact canceled my I-129 and processed my I-130. Now, more waiting with NVC. I highly suggest everyone to try contacting their local represenative. I only wish I had done it sooner. Below is the email following the phone call.

Dear Jason,

Congressman Smith was contacted by the US Citizenship and Immigration Service California Service Center. CSC reported that your

I-129F K-3 visa petition has been administratively closed because they have processed the I-130 Immigrant Visa petition. The I-130 was approved and has been forwarded to the National Visa Center.

The National Visa Center is responsible for scheduling all appointments for immigrant visas at US Consulates and Embassies around the world. It can take 2 weeks to 3 months for a case to show up as received at the NVC processing center. We will contact NVC in 2 weeks to check if your case has been received.

We will obtain the case number and the date of your wife's Immigrant visa appointment. As soon as we have additional information, we will contact you.

Thank you for allowing Congressman Smith to be of assistance.

I just got off the phone with CSC and they told me they are working cases with mid-August NOA1 dates. She also stated that the new procedure is to administratively cancel I-129F petitions and continue with the I-130. Honestly, that sucks. I know that the CR-1 is the "better visa", but I could care less about the additional AOS fees or the fact that my wife couldn't work on a K-3 without EAD. She isn't going to be working anyway, so the additional wait at NVC brings us no benefit at all.

You can not listen to that information. Divine mercy was told 3 times that her I129F was canceled because her I130 was approved. Yet when it was time for her petition it was approved. Her I 130 was approved and already stored. There has been plenty of people who I129F has been approved after their I130 and some people who's have been approved together. The I130 goes to storage until the petitionee is in the us. Then the forward the I129F to the NVC.

still waiting! our 129F was touched twice in the last week,so maybe something will happen soon. I've gotten quite used to not getting excited about any movement within uscis, but who knows. going on 7 months now, so i pray to god for an approval soon. hanging in there.

I'm new VJ member and my husband filed our K3 on August, so let me join.

When we got my NOA2 for our I-130 and just had I-129F received, I was freaked out. But now, when went throught 14 pages, I think my I-cl129F will be cancelled soon, you can see my timeline to know why I said so.

Sent I-130 on 8/28/07

NOA1 on 12/21/08 close to 4 months to have NOA1, paintful

Sent I-129F on 1/2/08

NOA1 for I-129F on 1/2/08 this is quick

Then NOA2 for I-130 approval

Now, we waiting their mail and see how they told us to do.

Do you know where it goes in storage. The reason being is because I was approved almost 6 weeks ago and my file hasn't reached NVC. Since I was going to do the K-3, I think my app is lost in limbo.

Also Divine mercy, I know she was told the her i-129f was canceled, but correct me if I am wrong, she contacted congress and they worked to get it going. Therefore, I if USCIS says its canceled, unless you persue getting it pushed through, I don't think it will get approved.

She did nothing to get her I129F going. She stated to me when I asked her how did she get the I129f approved. She was getting ready to send in her Affidavit of support information when she recieved an email stating that her I129f was approved.

When I realized that this was the case, I wanted to know what she did. she said nothing, it was never cancled.

My I130 was approved in September. NOA1 from the I130 was July. That was a quick approval.

My NOA1 from my I129f was two days after my I130 approval. My laywer messed up by mailing it out two months late. MY husband would be here right now. Ok this will be the last time I say that in a post. *wink
