Did you provide a US based domicile?

Hmmmm....kind of? I used my Mother's address as a permanent residence in the US, and she is going to be our co-sponsor. That probably made a difference.

But the NOA1 came to us here in Japan, and I imagine the NOA2 will come here as well.

Using a foreign based address had better not mean a return - we have no current USA address on our i-129-F and we got our NOA1 OK to the UK. We did put a USA address on the i-129F form 'Question 14. Address in the United States where your fiancé(e) intends to live.'

Doesn't it make sense that some people might be living together in other countries and not have a USA mailing address for whatever reason?

Worried now!!!

Using a foreign based address had better not mean a return - we have no current USA address on our i-129-F and we got our NOA1 OK to the UK. We did put a USA address on the i-129F form 'Question 14. Address in the United States where your fiancé(e) intends to live.'

Doesn't it make sense that some people might be living together in other countries and not have a USA mailing address for whatever reason?

Sounds like you need to resubmit, but make a breif coverpage explaining the special circumstance. That as listed on page X of the I-129F instructions you are to file to CSC....

This can hopefully ensure the package doesn't get returned to you again. Best of luck!

Sounds like USCIS did a major SNAFU if you reside in the US and filed at CSC.

Get your senator or congressman involved!

I currently reside in China. My last place of residence in the US was Idaho and according to the USCIS website I should therefore apply at the CSC.

Everywhere else I looked said the same thing. It even says so on the application.

Would submitting it again do anything, or would I just meet the same problem?

Yes, submit the petition again with a copy of the letter you got and a new cover letter addressing it. I-129F petitions cannot be filed at Consulates abroad.

You can also add a letter requesting an expedite based on USCIS mistake. If i remember correctly, there was a post on the site where somebody's petition was returned in error, he requested an expedite and the request was approved.

I don't have a timeline because northing's happened yet. I sent in the petition, two months later they sent it back...

Yeah, that's what we did too. That's what I meant by "kind of..." I used my Japan address for everything, but put that down as our destination.

And we got our NOA2 approved and all that, soo....

Update: I just called the USCIS and the very helpful lady said I need to live in the USA to petition for a K1

and it is impossible to bring my fiancee over if i currently do not reside in the USA.

That's weird...when I called, I was told it was unusual but certainly not against the rules...

I was living in Russia with my fiance when I submitted the I-129F. I used my local address abroad, sent it to the Vermont service center (my parents' service center.)

Sorry you are having trouble!

Make sure your cover letter clearly states why you are abroad, for how long, because the 2 of you ARE wanting to live in the US (otherwise you would not be filing 129F).

February 3, 2005. Applied for K-1.

July 14, 2005. Email to NVC congressional unit

Nov 2, 2005. Letter to congressman

Nov 8, 2005. Letter from congressman

December 19, 2005. Visa interview in Moscow. (250 days at NVC)

January 27, 2006. POE: JFK.

April 8, 2006. Wedding in USA.

April 19, 2006. Apply for AOS.

July 12, 2006. AOS Interview.

February 26, 2008. Letter to congresswoman.

March 19, 2008. Conditional Permanent residence began!!

2009: Wake up and get on the uscis train again - lifting conditions

Dec 21, 2009. Eligible to apply to remove conditions

February 2010: 10-yr Green Card Received
