EAD-122 days and Counting

Hi

I'm wondering if there is anyone else who has ever had to wait for their EAD as long as my husband has. We sent in the I765 in July and received our receipt on July 17. Hubby had his biometrics on August 14. Since then NOTHING. USCIS has acknowledged it's outside of the normal processing time and erroneously sent us to the Atlanta Immigration office to get a temporary EAD which they no longer do.

The day we returned from Atlanta I contacted both my Congressmen who are attempting to intervene on our behalf. Today Artur Davis' (one of my congressmen) liason called and said they finally got word back from the California Service Center to please allow them 30 more days-that the case was with an adjudicator but that we should hear something within 30 days. The Congressional Liason said she told the USCIS that 30 more days was unacceptable but that the response was to please contact them again after 30 days if they haven't heard anything.

For almost 6 months my husband has been living here virtually as a ghost. He can't get a SSN without the EAD which means he can't get a bank account much less a job. He's so sick of cooling his heals doing nothing. He's taken every Red Cross course there is to take and is volunteering here and there but to him, it is nothing like having his own job.

This is absolutely ridiculous. Other than going to an infopass appointment (which we have and they claim they have put in an expediting request) and contacting our Congressman (which we've also done...both the Senator and the Representative) is there anything else to do other than wait endlessly until they decide to give my husband his EAD?

Any suggestions would be nice.

We are going through the exact same thing. Filed in July, Bio in August, nothing since. We were told last week by customer service that they are just now working on the ones filed in July and to call by the end of the week and we might get more info. We asked if the infopass might be the best thing to do but both times the woman has told us that we would virtually get the same info. He was, however, able to get his SSN and open a bank account with no problems. It might be because we live in a small town and they didn't know any better though.

10-2005- met in Wales & began dating (We were students)

07-2005- found out we were pregnant (and they said I couldn't conceive-yay!!)

09-2005- vacation in Croatia where he sneakily bought my engament ring w/o me knowing

10-2006- he proposed

11-13-2006- mailed I-129F

11-22-2006- NOA1

11-30-2006- Touched

23-01-2007- Pete comes to the US to stay as a tourist for 90 days-no problem arriving on a one way ticket!

13-02-2007- NOA 2 (email)

20-02-2007- NOA 2 (postal letter)

05-03-2007- Packet 3 received

08-03-2007- Packet 3 stuff mailed back

08-03-2007- Baby Samuel is born!

23-03-2007- Packet 4 received

25-05-2007- Medical exam

27-04-2007- interview date

02-05-2007- Visa received!

11-05-2007- Pete flies back to the U.S.

06-25-2007- We get legally married

07-18-2007- Mail off EAD and AOS

07-31-2007- EAD and AOS received at national center

08-15-2007- Biometrics in Louisville

08-31-2007- "real" wedding with the dress and cake

04/28/2008- AOS Interview! (We passed!)

05/07/08- Card arrives in mail.

I have an update...

When we called USCIS two weeks ago on a Monday they told us that they were just then working on EADs filed on July 29th. Since we filed on the 31st they told us to call back at the end of the week. We did. At the end of the week they told us that they were just now getting to those filed on July 25th and to call back in a couple of weeks. So they regressed? Well, two days ago we called again. This time, the guy told us that we have had a hold put on the EAD and that it went on it October 30th (that was the first time I called when they didn't tell me anything at all). We asked if there was a problem and they said they didn't know-to call back in 60 days. This is crazy. We contacted the Congressman and so far nothing.

I guess getting the Congressmen involved must have helped. Yesterday we received my husband's card in the mail. There was never any updates online on the case and even last week when my Congressman's office followed up with their initial contact, they received the message that they should follow-up in 30 more days as the case was still processing. Then yesterday voila the card was there. Finally...good luck on everyone else who are going through this madness.

My EAD was over 130 days. I sent a letter to my congressman on Nov. 6th and then on the 7th I was notified my EAD was mailed. So he didn't help but for some reason it felt like it did. lol

For people reading this who are still waiting on their EADs and it's been 90+ days - schedule an Infopass appointment ASAP if possible. Calling the information line might light a tiny fire under their bums, but going in for an actual appointment and letting them know it's past 90 days will be more effective. If they're not able to help, then get your congressmen and women involved.

Infopass isn't always an option for everyone, but you should try to go if you can.

05/28/2008 - Received AOS Interview notice

07/10/2008 - AOS Interview-APPROVED pending fingerprints

09/22/2008 - GREEN CARD IN HAND!

Removing Conditions

06/04/2010 - Sent I-751

06/07/2010 - NOA1

06/09/2010 - Check cashed

07/22/2010 - Biometrics Appointment

09/08/2010 - Card production e-mail
