I have three questions:

1. Do I (petitioner) have to obtain a police certificate? OR only my fiance (beneficiary) need to obtain a police certificate from his country?

2. Do I have to obtain status that I was never married before? Or only my fiance need to obtain single status?

3. He was born in the North and I was born in the South. His mom last name is the same last name as my dad. Both of our parents do not have any birth certificate. We only have ours. Do we need to obtains our parents birth certificate to prove that we not related at all? Should I even worry about this?

Hello and welcome. To avoid any future RFE (Request for Evidence) you should provide the as much as possible. I submitted my fiancee's Affidavit of Single Status.

1. Only the beneficiary needs to obtain a police certificate. This can be done after you receive the NOA2.

2. Your fiance will need to obtain an Affidavit of Single Status. You can download the form here: http://www.vietnamconsulate-ca.org/form/docthan-tuyenthe.pdf

Also, you will need a "Letter Of Intent" for each of you. You can see an example of the letter here: http://www.visajourney.com/examples/Fiance...r_of_Intent.doc

3. With this one, try and see if you can obtain both of your parents birth certificates. They may or may not ask depending on how much evidences they see that you have a bona fide relationship. But it is good to prepare ahead of time just in case that they do ask. In our case, although my parents and her parents do not share the same last names, I've gathered both of our parents birth certificates including ours as well. In our case, I was introduced to my fiancee by her aunt who lives here in the US. I've also obtained her Aunt's birth certificate. There are many uncertainties when we're dealing with the HCM Consulate so the best advice I can give you is to prepare as much as possible.

Thanks MR2nice! I just send my I-129F out last week. I am very nervous and anxious, I don't know what to expects.

For the Birth Certificate, my parents came here in 1992, so they don't have their BC. If they need to obtain their BC, do I have to go back to VN to do it?

As for status of single, I don't have to get one either? That's strange because I heard from others people that the petitioner also have to get a letter from the court or church stating that you was never married before. I just want to verify it.

Individuals born in Vietnam who need new copies of their Vietnamese birth certificates need to contact the office of the People's Committee of the district where they were born: the district where their mother was then resident according to her Ho Khau. The district People's Committee can issue certified copies of a birth certificate (Ban Sao) based on their records of the original birth certificate. Alternatively, the office may provide an Extract (Trich Luc) of the information in the birth record on file in their office.

If you are not able to obtain a birth certificate because records have been destroyed or the government will not issue one, you must obtain a statement to that effect from the civil registrar's office and submit secondary evidence of birth. Secondary evidence of birth can be old family household registrations, school records, or baptismal certificates.

For your second question. No, you do not need to provide an Affidavit of Single Status if you're the Petitioner, filing for the K-1 Fiance(e) Visa. What you've heard from others are for those that got married to their wives abroad. They would need to show the Affidavit of Single Status in order to get marry in the country where their fiance(e) resides. This could also depends on the Country too.

Thanks MR2Nice,

I checked my bank statement online today. I saw my check was cashed. I heard some people said that they can look on the back of the check to find the receipt numbers, and based on that numbers you can go online to check the status of your application. I look on the back, but there so many numbers, I don't know which is which? Can you help me out? Thanks.

On the back of your check, look for a Receipt Number that starts with WACxxxxxxxxxx, where x is a 10 digit number.

Then visit this URL to register: https://egov.uscis.gov/cris/jsps/login.jsp

After you registered and logged in, add your Receipt Number (WACxxxxxxxxxx) to your portfolio. From there you can monitor your case 24/7. When you see people say "Touched" it means that the case got updated with a new date under the column Last Updated (mm/dd/yyyy).
