Greetings all, i am writing from Kochi in South India, where i am visiting for dental treatment. I arrived in the US on a K1 in June 2006 and my AOS is pending. I made one trip overseas last April 07 for which an AP was obtained. I decided not to get one this time because i was so sure i wouldn't want to return to the US, because i considered my marriage to be failing and i intended to leave permanently. As the time to leave approached, i began to to be less certain that my marriage was beyond saving, but by now there was not time to wait for the AP, (my first one took over 2 months), everything was arranged for my dental treatmnet in India. So to cut a long story short, i now want to re-enter the US and continue with my marriage.

What do i do? Anyone been in this sort of pickle before?

Of course I am feeling like a total fool.

1st was the AP you got before not good for multi entry.... most are...

If it is not good for multi entry then I am sorry to tell you that as you left the US without AP or a greencard you have abandond your AOS and your spouse will need to file for a K3 or CR1 visa and pay all the fees and you will need to wait in India for interview and approval...

You need to check your AP documents to see if they are still valid...

Hi... Well your not the only one... My husband was in the process of getting his AOS sent in all the papers and was waiting then a sudden death in his family he returned home and didnt apply for an AP that's something we werent thinking of at the time. I talked to an immigration attorney operators at USCIS and was told by them all the same thing have to start all over by filing for the spouse the I130 IR/CR visa... You have to send in all the same documents you sent in before pay the fees again. Gotta love the freakin government
