You file for her AOS in her married name... you get her SSN in her married name, you change her name at the Bank, doctors, insurance companies and anywhere else that she has any business with that know her in her maiden name...

The marriage is what allows you to do this, you will need to be able to show your marriage certificate to allow the change to happen... so all she has to do is start using it...

We changed it when we filed Claudeth's AOS. Once we received the EAD we were able to change her name on the social security card. She got a California identification card in her married name using the EAD also.

Ive read all through the forum. I cant figure out how I legally change her last name now. Do I need to go to the county clerks office or ??

In Texas - you take the marriage certificate to the DPS (Driver's License Office) and get a new ID/DL, then also to the SS Office to get a new card and ta-da, legally changed. (Of course after you get new cards, you may need to change any business accounts as well - banks, employment, insurance, etc.) :thumbs:

(This differs from state to state am sure...)

To legally change a name is an individual state by state thing... need to check your local requirements. To change a name with the USCIS is something completely different

We just went through trying to figure out the same thing (I also just got married on a K1 to my USC.) I am sure it may differ somewhat from state to state but hopefully this helps a bit. You guys should just apply for her AOS papers in your name and whenever you go for the SSN do the same. Depending on where you live it may also be helpful to get an I.D. from the DMV but you'll need the proper proof (for us, my passport, marriage certificate, and proof of address was acceptable.) But we haven't gotten it yet because we didn't have anything they would accept as proof of my residence just yet. Ugh! Anyway, we'll probably be able to get it tomorrow finally! :)

March 6, 2007 - I-129F package sent

March 21, 2007 - I-129F NOA2

October 17, 2007 - K1 interview - approved

October 19, 2007 - K1 arrived in mail

October 21, 2007 - US entry

October 23, 2007 - Wedding day

November 27, 2007 - AOS, EAD, AP package sent

December 7, 2007 - Received all 3 NOA's for AOS, AP & EAD

December 10, 2007 - Received letter for biometrics appointment

January 2, 2008 - I-485 transferred to California

January 3, 2008 - Biometrics

January 23, 2008 - AP approved

January 25, 2008 - Case status finally updated: AP approved January 23!

January 31, 2008 - EAD card production ordered

February 2, 2008 - AP arrived in mail

February 5, 2008 - Sending a letter/RFE to CSC

February 5, 2008 - EAD card production ordered (again?!)

February 7, 2008 - RFE/letter arrived at CSC

February 7, 2008 - EAD approval sent

February 9, 2008 - EAD card received, dated January 23rd!

February 25, 2008 - CSC finally acknowledges receiving RFE

February 27, 2008 - I-485 APPROVED!

February 27, 2008 - Online case status: notice mailed welcoming new permanent resident.

March 3, 2008 - Received welcome letter

March 3, 2008 - I-485 approval letter sent

March 6, 2008 - Green card arrived in mail.

November 2009 - Removal of conditions...

Most Social security agencies require to have proof that you are here legally to give you a SS card. It is through them that you do the name change.

Documents that they should accept: K1 if you have been here less than 70 days or so.

EAD card (work permit)

Green Card

You'll also need a picture ID such as a passport and your marriage license for the name change.

1) this is a public website, for your security you shouldn't use your real name.

2) apply at USCIS with the name she will be using. If she is taking your last name then apply with it. If she wishes to keep her maiden name then you use that one.

Keep in mind that changing names later on in the process will cost you a fee so talk about it with your wife and decide which one she wishes to use.

If you apply for SSN before you get married, obviously you are still using your maiden name...so...

You should wait until after you are married to get SSN or what...I'm confused.

So..I've read on here that people enter on the K1 and after about 2 weeks (they wait to make sure that the fiance is in the "system") they go to get the SSN....then get married, then apply for the AOS.

If you apply for SSN before you get married, obviously you are still using your maiden name...so...

You should wait until after you are married to get SSN or what...I'm confused.

You can certainly wait, and save yourself a trip to the SSA office, but in my opinion it's better to get the SSN right away in maiden name, then change it later. That way you have the number if you need it (trust me, you will). There can be problems getting the SSN if you get to close to the I-94 76-day cut-off and the SSA causes a delay or screws up your application (like they did ours).

It's easy to change the name after marriage anyway. My advice is to get the SSN ASAP in your maiden name.
