I have a question about my NOA 2's

Timeline

Hey everyone, I have a question I would love if someone can help clarify it for me. I have read here on the forums that when you submit the I129f and the I130 that the USCIS will hold the I130 until the spouse comes here to adjust status. I heard that on the I130 NOA 2 that it will say something about the spouse is already here and will adjust status while the I129f NOA 2 says it will be forwarded to NVC.

I looked at my NOA 2's for the I129f and the I130 and they both say they have been forwarded to the NVC on November 8th, 2007 and the I130 doesnt say anything about USCIS holding it until we do our AOS. What I'm asking is that have they both been sent to NVC since it has stated it and hopefully I can go with the CR1 instead of the K3 so when Hassan goes for his interview hopefully it will be the CR1 interview and he can come here on a greencard and we wont have to deal with the AOS and the new fees? I think, I-129F and I-130 are independent of each other. If CR-1 and K-3 go to the Embassy about at the same time, then Embassy cancels K-3 and goes with CR-1. If you don't want to pursue K-3 while it is in NVC, you can cancel it by writing.

I am sure, others will advise too.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

If any way possible stick with the I-130. If NVC did receive it you should be receiving paperwork relating to it soon.

At the same time the I-129F will keep moving and will be sent to your embassy.

You are in a GOOD situation as you can choose which later on.

K3 interview will probably occur sooner.

At the same time a bit longer wait for the CR-1 will pay off in the long run.

Wish we'd have been more patient and stayed with the CR-1.

We went thru hell and cost us a LOT of money adjusting status for the K/3.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Very interesting Melissa. You can call NVC and use the automated system anytime to see if your I130 has been received. You should start trying and see if it was indeed sent or a mistake in the NOA2 for the I130. You can also call NVC and talk to an operator to see if the I129F made it to and out of NVC.

The public notice about forwarding only the I129Fs to NVC and holding the I130 for K3s can be found here.

They announced the change last year, but have had some trouble implementing it fully early on (especially with linking the petitions). Yours were sent together and approved together so this would be very strange if they can't follow their own policy here, but you never know. Good luck :thumbs:

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
