I ENTERED THE USA WITH A K3 VISA I AM IN THE PROCESS OF COMPLETING THE PAPER WORK NEEDED SUCH AS AOS, WORK AUTHORIZATION AND g-325.

WHEN I WAS IN MY HOME COUNTRY I HAD TO SUBMIT A MEDICAL EXMAN BLOOD TEST, VACCINATION, AND CHEST X-RAYS IN ORDER TO GET MY k3 VISA. WHEN I ENTERED THE COUNTRY THE MEDICAL EXAM WAS LEFT WITH THE OFFICER SO I ASSUMED THAT THE US IMMIGRATION WILL GET THE MEDICAL EXAM.

NOW MY LAWYER IS TELLING ME THAT I HAVE TO DO ANOTHER MEDICAL EXAM , AND I WILL BE DOING THE SAME EXACT THING OVER AGAIN. IT DOES NOT MAKE SENSE, WHY DO I HAVE TO GET ANOTHER VACCINATION, CHEST X-RAY AND BLOOD TEST WHEN I DID IT TWO MONTHS AGO AND PAID ALMOST $400.

LOGICALLY, THEY SHOULD NO ASK FOR IT IF MY MEDICAL FILE WAS PASSED ON TO THE IMMIGRATION AT THE TIME OF MY ENTRY ON THE TERRITORY.

cAN SOMEONE HELP ME AND TELL ME WHAT I SHOULD DO?

No you do NOT have to get the physical again, your ill-informed lawyer is WRONG. Please click on the GUIDES link at the top of this page. You just need to go to a civil surgeon and have them fill out the Vaccination Supplement, hopefully you have the records of the vaccinations you took before. The government DOES have your medical records and they will NOT request another one. None of us took another physical exam :no: , and we got approved fine! :yes:

Print this out and show it to your lawyer and to the civil surgeon if they try to charge you for a complete medical.

FEDERAL REGISTER INTERIM REGULATIONS

"C. Medical Examinations

According to 8 CFR 245.5, aliens seeking to adjust status are required to undergo a medical examination performed by a designated civil surgeon to determine whether they are inadmissible under section 212(a)(1)(A) of the Act. To date, applicants for K nonimmigrant visas have been required to obtain a medical examination abroad pursuant to Department of State regulations at 22 CFR 41.81 prior to entry, and the medical examination is not repeated if they apply for adjustment of status within 1 year of the dat e the examination was performed. They are, however, required to submit with the adjustment of status application a vaccination assessment completed by a designated civil surgeon in order to establish their compliance with the vaccination requirements under section 212(a)(1)(A)(ii) of the Act.

The Service will continue this same policy for the K-3/K-4 nonimmigrants. K-3/K-4 nonimmigrants who file their adjustment of status application within 1 year from the date of the medical examination overseas will not have to submit an additional medical examination. However, the Service notes that applicants whose medical examinations overseas revealed a “Class A” or “Class B” condition (as defined by 42 CFR 34.2( B ) ) must establish upon application for adjustment of status that they complied with those cond itions imposed on the initial admission. Failure to comply with those conditions means that a new medical examination will be required.

IF YOU HAD YOUR ORIGINAL MEDICAL MORE THAN 12 MONTHS AGO YOUR LAWYER IS RIGHT YOU WILL NEED A NEW MEDICAL.... IT IS ONLY VALID FOR 12 MONTHS.....

My medical was done 2 months ago, now i called the doctor and they are trying to make me pay $300, and they are telling that they cant fill the vaccination supplement because they can;t accept vaccination from other doctors.

I dont understand why did i get a visa if the ambassy approved this vertified doctor who gave me these vaccinations.

I mean this a huge frustration!!!!!

Yes it is terribly frustrating, all of us went through the same thing! There are doctors who will do the vaccination supplement by mail, for a small fee. Please see the following VJ thread:

Could you please tell me what is Class A and Class B condition?? My wife's approval was delayed because they said she was "Class B" so needed new medical. We submitted new medical and vaccination and still waiting for about 2 and a half month for approval?? How long does it take after you submit new medical to get I-485 approved? Our ignorant attorney did not know about it even though I asked her repeatedly before interview if we need a new medical and she said "NO". By the way my wife came on a K-3 visa and applied about 7 months after entry to the USA for adjustment (I-485). Thanks.

You might want to just get a I693A vaccination supplement done, since you had the medical examine within past year. I think your lawyer may have overlooked that fact and that you only need to submit a I693A vaccination form from a US Civil Surgeon. Basically you should have been given a DS3205 vaccination form copy signed by your Medical exam Dr in your home country few months ago, you would then take that form and get in touch with a US civil surgeon and have them transfer the information over from the medical exam vaccination DS3025 form onto your I693A form, which then gets mailed in with your AOS application.

Try this Civil Surgeon, she does it all by mail on the I693A and for only $10 and completes it by 10 days or less for you.

Call them you may have to leave a message, but they do call back within minutes or the day you call them and then tell them what you need and they give you instructions on what to mail or fax them and they are very good.
