I plan to marry my fiance this December and file the K-3 in January when I come back to the States. Do I have to change my last name on all my documents, i.e. passport, before I can file the K-3? Should I use my husband's last name or my maiden name on the forms? If you guys know of any guidance on this, please forward me a link or something. thanks!

My Timeline:

My husband and I were college sweethearts. In fact, we were each other's first love. We broke up for a while and after 8 years, we started talking again. We finally got back together in 2007 and decided to get married last December.

You can use your new married name on the forms, and in your passport if you wish to.

It is completely out to you whether you will take your husband's last name as your last name. You can keep your current legal name, if you wish to. If you decide to take your husband's last name, you should use this name in all documents including the passport.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Social Security is behind on getting cards out. I went to the DMV to change my name and Oregon does not accept non-US documents as proof of name change. So my UK Marriage Certificate was useless there. I went to the Social Security office and stood in line for a while and finally got to someone. It still took 6 weeks to get my new card. After I had it it was really easy to get everything else changed.

HeLLO!

Prior to your questions, My husband and I were married already before we filed the K3 visa, but in all of my forms likes I-130 and I-129F I used my single family name instead of my married's name because I had my passport already and that I am using my single name on it and since we think it would be alright. so we just used my single name. so far we havent receive anything from USCIS yet that we need to changes my family name in all the forms that we submitted on them, and I was praying they wont :innocent:

I hope this will help but if you know some information about this let me know...

Take care and Goodluck!

We did similar. We didn’t want to waste any time getting our visa petitioned filed, so my wife left her maiden name on all documents and passport. The name on her passport is the most important and the one she will use for all processes. We did provide her married name as “Other names used”.

Unfortunately, we will probably have to wait, get SSN in maiden name, and then change her name before we can change her name on any US identifications. In the mean time, we are using both names where ever it is allowed.

It would have taken a few extra weeks, but getting her named changed on her passport and government ID would have made the process much easier after she arrives in US.
