hello there...

i'm little bit confuse what date i'm qualified to apply for citizenship

I'm applying for naturalization on the basis of marriage to a US citizen:

i got my residence permanent on March 21 2005

and also i'm aware that i can apply in 2 years 8 months.

so my question is i'm qualified to apply in NOV 20 2007 ?, if i calculate NOV 21 2007 which comes to

2 years, 8 months, 1 day including the end date

is that correct?

thanks.

I say wait that extra day just to be sure. Im sure that one day will not hurt if you've waited 2 years and 8months.

I believe you may apply for Naturalization starting 90 days before the 3rd year that your permanent resident card was granted starting the date of your conditional permanent resident card and before you meet the "continuous residence requirement" (have been physically in US for at least 18 months and been not out of the country for more than 12 months). The date is on the back of the card. If your permanent resident card is granted on March 21, 2005 I think you can start applying on Dec. 22, 2007. I'm sure others here can give more better insights.

NATURALIZATION

7/09/2007 - Sent N-400 to Vermont

07/11/07- Priority Date

8/07/2007 - Received NOA 1 receipt for $400

8/30/2007 - Received notice of date for Fingerprinting

09/25/2007- Fingerprinting done

02/19/08 - Received notice of interview

04/18/08 - Interview in Philadelphia

06/16/08 - Received Oath ceremony invitation

07/02/08 - Oath Ceremony date - Pennsylvania Convention Center

Happy Independence Day!

its my mistake and i dont know what i was thinking about 8 months and you are correct it should 2 years 9 months.(90 days before my 3 years)

i meet all other requirements the only thing i confused is about when i should file end of dec 2007 or jan 2008 ?

thanks.

Remember that 90 days is not exactly the same as three months. You can file 90 days before the "resident since" date on your GC, which would be somewhere around Dec 22, if I did my math right (I'm not very reliable). That's assuming you meet all the other requirements on the filing date. If you have any doubts about the date math, file a week after you're initially eligible, to be sure.

There's no harm in waiting until January, except that your application will be processed a tiny bit later. But they probably don't do too much work over the holidays, anyway. It's not like removal of conditions; there is no deadline. You can file as late as you want, as long as you meet the eligibility requirements on the date you file.
