Unusual delay in receiving I-129 receipt

Hi everyone,

I'm new to this website, but I found it to be a very valuable resource in evaluating the completeness of my application and learning what to expect. So thank you!

I mailed my I-129 application packet on October 1. I received my canceled check very shortly thereafter and assumed that I would receive a Notice of Action or receipt within the month. It is now November 18 and I'm getting worried. My fiancé (from the United Kingdom) said not to call and antagonize since our wedding date isn't until August 16. However, I'm the nervous one in our relationship!

Has anyone had this issue? Did you call, and if so did it get rectified? Did it take a long time?

Don't worry about not receiving your NOA1. It means nothing. We filed in June and never received ours. All you want is your NOA2, which will be some time down the road.

You never received one either? Is this fairly common? How long until you received your second notice, if you don't mind my asking?

We haven't received our NOA2 yet. We received an RFE for my fiancee's translated birth certificate on the 31st of October so it took about 2 weeks to get that back to them. We are hoping to be approved this week (fingers crossed) or the week after. If we had not received our RFE, we probably would have been approved on or about the 31st of October, so that is a little over 4 months of waiting.

Many people experience delays in receiving the NOA1 or never receive one at all. The important thing is that your check has been cashed. The back of the check should quote your case number and this is really all you need until you receive the NOA2 (which IS the one to worry about).

For timeframes you need to look at the visa timelines or maybe take a look at the K1 October filers forum to keep a track on when similar filers are receiving news. Currently USCIS are finishing June applications and making a start on some July petitions.

You have no need to worry but you'll need plenty of patience. Good luck with your petition!

Thanks for your help, everyone! I did indeed check the back of the check and found our file number. They've received it and apparently mailed a notice, so it must have just been lost in the mail.

I didn't get one either until I emailed them to let them know. They sent me a Replacement Receipt Notice. What's important is the NOA2 because you will need that for the AOS. Good Luck with the process.

The delay is not unusual at all.

Lots of people don't get it right away, and some don't get it at all. If you still don't have it after 90 days, you can call and get a case # and request that another NOA1 be sent. No worries!
