Hi everyone, i filed for the i-130 back in january and its been approved and i've recieved the ds230 biographical info for my girl in Jordan and sent it back priority to the NVC on 11/14/2007. Few questions if you all dont mind

1-Question 13 asked for her street address, thats uncommon in Amman, at least where she lives. There is no Street address so I put her city country and the name of the homeowner(her father). I hope i didnt screw it up not sure what to do had no other choice but i remember submitting a CHANGE OF ADDRESS form for her so that anything sent to her should come to my home address in the states specifically for that reason. Wondering if that packet (#3 i think, her instructions) that they send out will come to me or what? and who sends it out, the NVC or the Embassy in Amman, Jordan?

2-I hired a lawyer to assist me over hear and all seems to be moving along thank god, but we didnt file the i-129 only the i-130, i was told processing times ar almost the same with less hassle? Am I doing the right thing? Just really stressed and I miss my wife hard to trust the ones who say they have all the answers so any comments on that would be highly appreciated.

3-Last, any clue as to how much longer until she gets her interview, trying to plan a big celebration since our reception wasnt so fancy.

Hello Yazn

1.) Amman is notorious for sending Packet 3 to the USC (even when people had indicated a Jordanian address) so the packet will most likely come to you. Once NVC completes your case, I would suggest emailing Amman (include your wife's name and case #) and repeating your address for their records. But the consulate may eventually need a local address for your wife -- when they're ready to issue the visa, they usually send it by courier.

2.) If you are already at the DS-230 stage, you are almost done with NVC -- barring any RFE's, your case may get completed by the end of this month insha'allah and be heading to Amman within a matter of weeks. Filing an I-129F would be a waste of money at this point. So hopefully the major part of your wait is over. Forget the I-129F -- you don't need it.

3.) These days, it seems to be taking Amman 2-4 months to schedule an appointment, once they receive the case from NVC and get it entered into their system.

I take it that by now this is in IR-1 / CR-1 catagory now.... Am I wrong? It has been 4 months since I filed and not even a touch. I did not send in the I-129F because if there was a mistake on the I-130 I felt it would be best to correct the I-129F before I sent it...... Wondering now!!!!

Well to be honest im still having difficulty understandin most of the abbreviations, for instance i really dont know what IR-1/ CR-1 even represents. But my wifes case is now pending completion by the NVC, i sent in the DS-230 and waiting now for the case to be sent to the embassy in Amman. Anyways i started in Jan 07 and got a it took just around 4months to get a response then about 3months for approval. Anyways my advise is dont bother with the i-129 if your married, not necc. and they take around the same amount of time with less work and hassle. Before people did the both of them because i-129's were processed quicker, not anymore

The terminology can be really confusing. There used to be a list somewhere on this site explaining all the abbreviations -- anyone have a link ?

Anyway as far as IR-1/CR-1 -- if you are married more than 2 years at the time the visa is issued, your spouse will get an IR-1 -- the permanent resident visa. If this is the case, you're done -- a 10-year green card is issued (which you do have to renew every 10 years.)

If you are married less than 2 years at visa issue, your spouse will get a CR-1 -- a conditional permanent resident visa, and the green card is good for only 2 years. With the CR-1, the immigrant must "lift conditions" during the 3-month window before the 2-year anniversary of arrival in the U.S. -- another round of fees and paperwork and evidence to file with USCIS. After that lifting of conditions, the immigrant is issued the 10-year card (which has to be renewed every 10 years.)

And yes you are right -- even with all this, the CR-1/IR-1 is a much better visa than the K-3 -- it gives the immediate right to work and travel, etc. -- you don't have to go through AOS or file for advance parole. And they're both taking around the same amount of time to process right now. So I agree 100 % -- there really doesn't seem to be any advantage for married couples to file the I-129F these days.
