Today we received RFE for supporting tax documents ! Similar to SaraTara's but my husband is not self employed and i know we submitted his tax return - the only thing i can think of is that we didnt submit the W2 as we thought we sent the more important doc. Now i am wondering if we should submit the latest 3yrs but the note states " for the most recent tax year". Anyone else got this situation?

On a side note can i presume that they have examined the whole package and this is there only issue with the package?

Biometrics went fine on yesterday - so it was a weekend of up and down.....still i guess i know someone is looking at it.

Send them what they are asking for!

Many thanks for your swift reply - i have just doubled checked with my husband - he is adamant we sent the tax return and the W2 for 2006 .... getting a little frustrated with repeating what we have already done!

Just an innocent observation which some will love to argue over this, but realize what the directions say or give you the option of only submiting the most recent tax returns and documents for I864 but the reality is USCIS more than likely expects 3 years worth of those tax returns and or better yet the IRS tax transcripts for 3 years. They give you that option but if they only want or need one year's tax returns or tax transcripts, then why do they leave it open with next option or statement below saying you may send an additional 2 years worth if you think it will help you, otherwise why would they include it or print that statement if you only have to have 1 year most current tax records. Thus translation = we expect 3 years worth and it is at our discretion to RFE you if you only send in 1 year worth if we feel like it and we will ask for and like 3 years most current tax records. Realize it is a headache and pain but best to send them last 3 years IRS tax transcripts along with those copies of W2s, 1099s and federal tax returns to USCIS.

I did onder if they want the three years - then i re read the RFE : "in order to process your application further, the petitoner/sponsor on form I-864 affadavit of support, must submit all supporting tax documentation (W-2s, 1099 etc) submitted to the Internal Service (IRS) for the most recent tax year."

I wonder if anyone who has already had something similar can advise what they did - i rememeber getting a RFE for I129F for copies of divorce certificates which we had already sent and all we could do was resend what we already had sent them - but getting an rfe for what you have already done can be a little disconcerting.

Persoanlly I would send in 3 years with a cover note stating the 1 year request is enclosed, and an additional 2 years as more supporting evidence. It isnt going to harm you.... and if they dont want it they can just throw it away, im sure!

10-11-2007 Chicago received my AOS packet.

10-19-2007 Checks Cashed.

11-18-2007 Notice Date for Biometrics in Tampa on Dec 14th.

12-14-2007 Biometrics

1-19-2008 EAD Card Arrived

7-17-2008 Interview - APPROVED!

Received card about 2 weeks later.

Enjoying married life :-)

June 1st 2010. VT received my I-751 application.

June 3rd 2010. Check cashed.

USCIS is well known for pulling this. They did it to us too. They sent us a letter telling us that certain documents weren't provided EVEN THOUGH IT WAS OBVIOUS FROM THE LETTER THAT THEY WERE. I made an Infopass visit trying to prove my point but, alas, sometimes you can't convince idiots.

My husband got the same RFE, requesting the joint sponsor include all documents from the most current tax return. w2, ect.. So that is what we sent back to them, only the most current, 2006, all pages submitted to IRS. What we originally sent them from the joint sponsor was, the 1040 form. I wasn't too suprised they requested all pages, which was 24 pgs. We have not heard back from USCIS about the RFE, because it just got delivered back to MO, on the 16th.
