No problem. The change was actually announced well before the fee increase, in November of 2006. They were a little slow in getting it fully implemented. The public notice on this is here: http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

You are talking about the old way. I130s and I129Fs are now linked together and usually approved the same day. An approved I130 that has been linked to an I129F is sent to storage and held for eventual AOS. It is not forwarded to NVC. Approved I129Fs are forwarded to NVC.

If Rashid got both approved (but only 1 updated on the USCIS CRIS system), then I129F will go to NVC. If only I130 is approved and it has been linked to the I129F, then he will be waiting for the I129F to be approved.

Hi all,

I filed a K3 visa petition and I got my NOA2 for the I-130 first on Nov 15 this past Thursday from CSC. My I129F still says pending. So I called the USCIS and talk with an Immigration Officer and she told me that since the I-130 got approved first that the I129F is dropped and my wife will be coming in under the permanent resident visa. I wanted to know is this true that if the I-130 is approval first that they drop the I-129f. The officer said this better and faster. Have anyone experience this before and how much is the fees from the NVC before the package being send to my wife. I assumed that my that my petition is not a K3 anymore that it is IR1/CR1 is this true? Can someone give some explanation and some guidance on this...Thanks

I-129F has nothing to do with I-130's approval. It is only when they are at the NVC at the same time. But at least, your I-130 is approved and concentrate on your I-130 now while you wait for I-129F.

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Well, thanks for clarifying this, I had talked with someone this morning about the issue again at the USCIS. They transferred me to a spanish person who said to me that if they drop the I-129F from the system and process the I-130 they would have to refund my money. He also said that the I-129f is waiting on getting approved and that it was great that the I-130 gotten approval before. He also said it would stop the I-129F from being approved. Waiting on approval and then it is sent to NVC and I will deal with the NVC from there. I have heard and read on here that some got seen there I-130 approval the USCIS website and the I-129F had still said pending and when they got there NOA2 in the mail they got both NOA2 for I-130 and I-129F. I hope this is my case. A few have recieved the second NOA's this way I will should know today. They did clarify that my NOA2 was mailed out on the NOV 15, I should recieve today. If anyone heard of anybody recieving both in the mail each through it showed only one had gotten approved?

I checked my mail when I came home yesterday after work and I still haven't recieved my NOA2. Congratuation! So the NOA2 for the I-129F is with the NOA2 with the I-130. I will check my mail today when I leave from work today. I'm leaving early so I will let you know if I have recieved it. Thanks for the information.
