Timeline

Hi all,

I filed a K3 visa petition and I got my NOA2 for the I-130 first on Nov 15 this past Thursday from CSC. My I129F still says pending. So I called the USCIS and talk with an Immigration Officer and she told me that since the I-130 got approved first that the I129F is dropped and my wife will be coming in under the permanent resident visa. I wanted to know is this true that if the I-130 is approval first that they drop the I-129f. The officer said this better and faster. Have anyone experience this before and how much is the fees from the NVC before the package being send to my wife. I assumed that my that my petition is not a K3 anymore that it is IR1/CR1 is this true? Can someone give some explanation and some guidance on this...Thanks

Sounds like BS to me from the MISinformation operator!

USCIS would have had to change procedures recently.

They said better and faster. Definitely better but not faster.

Call again and you'll probably get a completely different answer.

Fees are $380 +80 last time I looked.

This sounds like misinformation to me. VJer YGandMat is in the same boat. His I130 got approved, but not I129F. He figured that the I130 would be forwarded to NVC, and waited and called but NVC never got it. Upon calling USCIS, they said that they connected his I130 to his I129F and are holding the I130. His I129F is still pending, but when it is approved, that will be forwarded, the I130 held for AOS.

That is in line with their last stated procedure for handling the 2 petitions. While the CR1/IR1 is a better visa, it will take longer for you to get (unless your I129F ends up being more than 3-4 months off). Call again.

This sounds like misinformation to me. VJer YGandMat is in the same boat. His I130 got approved, but not I129F. He figured that the I130 would be forwarded to NVC, and waited and called but NVC never got it. Upon calling USCIS, they said that they connected his I130 to his I129F and are holding the I130. His I129F is still pending, but when it is approved, that will be forwarded, the I130 held for AOS.

That is in line with their last stated procedure for handling the 2 petitions. While the CR1/IR1 is a better visa, it will take longer for you to get (unless your I129F ends up being more than 3-4 months off). Call again.

I was also told the same thing you were told, and yes, they always say that the K-3 visa is not as fast and that the I-130 is better, and that the processing time at the NVC is the Same...what a load of lies!! So then I called and talked to someone else (at the CSC...using the RFE path) and they told me they were holding my husbands I-130 pending approval of his I-129F. You should call again and hopefully you will get someone more knowledgeable.

I was also told the same thing you were told, and yes, they always say that the K-3 visa is not as fast and that the I-130 is better, and that the processing time at the NVC is the Same...what a load of lies!! So then I called and talked to someone else (at the CSC...using the RFE path) and they told me they were holding my husbands I-130 pending approval of his I-129F. You should call again and hopefully you will get someone more knowledgeable.

urge to race u re also right, even if YGandMAT is a she ,sure her spouse is a he,so it goes together, we re all doing this for our spouse, the petitioner could be she and the beneficiary could be he or vice versa. hahahahah!

So you are tell me that the I-129F is still going to get approved and the process is going to go forward. I will call again on Monday to tell to a different office. Because now this is upsetting. Has anyone went through this recently and the process actually took a longer to complete?

If USCIS is going to connect I-130 and I-129f. Would it help if I-129f or K3 is dropped or cancelled before it reaches NVC??? so they will only move forward with the I-130?? Please help.Thanks!

Congratulations! Probably they are holding the K3 longer because you filed after June 1, 2007 on the K3 and USCIS is requesting additional time for completion. USCIS always knows how to delay an application!

Essentially, now by filing the I129F it is too late. The I130 held, I129F will be forwarded upon approval. If you are in the situation where your I130 was approved and your I129F is still pending, you could try to cancel the I129F and see if they forward the I130 to NVC. But this is uncharted territory (as in I don't remember seeing anyone say that they tried this here on VJ or anywhere else). I suspect that since the I130 is queued for storage, they would still tell you to file the I824 to get action on that going again.

Congratulations! Probably they are holding the K3 longer because you filed after June 1, 2007 on the K3 and USCIS is requesting additional time for completion. USCIS always knows how to delay an application!

Rashid,

I-129F has nothing to do with I-130's approval. It is only when they are at the NVC at the same time. But at least, your I-130 is approved and concentrate on your I-130 now while you wait for I-129F.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

You are talking about the old way. I130s and I129Fs are now linked together and usually approved the same day. An approved I130 that has been linked to an I129F is sent to storage and held for eventual AOS. It is not forwarded to NVC. Approved I129Fs are forwarded to NVC.

If Rashid got both approved (but only 1 updated on the USCIS CRIS system), then I129F will go to NVC. If only I130 is approved and it has been linked to the I129F, then he will be waiting for the I129F to be approved.

I-129F has nothing to do with I-130's approval. It is only when they are at the NVC at the same time. But at least, your I-130 is approved and concentrate on your I-130 now while you wait for I-129F.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

You are talking about the old way. I130s and I129Fs are now linked together and usually approved the same day. An approved I130 that has been linked to an I129F is sent to storage and held for eventual AOS. It is not forwarded to NVC. Approved I129Fs are forwarded to NVC.

If Rashid got both approved (but only 1 updated on the USCIS CRIS system), then I129F will go to NVC. If only I130 is approved and it has been linked to the I129F, then he will be waiting for the I129F to be approved.

Hi all,

I filed a K3 visa petition and I got my NOA2 for the I-130 first on Nov 15 this past Thursday from CSC. My I129F still says pending. So I called the USCIS and talk with an Immigration Officer and she told me that since the I-130 got approved first that the I129F is dropped and my wife will be coming in under the permanent resident visa. I wanted to know is this true that if the I-130 is approval first that they drop the I-129f. The officer said this better and faster. Have anyone experience this before and how much is the fees from the NVC before the package being send to my wife. I assumed that my that my petition is not a K3 anymore that it is IR1/CR1 is this true? Can someone give some explanation and some guidance on this...Thanks

It is good to know. So have they started this, since the fee increased?

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
