Hello all,

I have a quick question, our AOS is pending, we filed on the last days of October and so far we have the biometrics on the 27th of this month. The question is the following, prior to meeting my wife, I entered the country as a F-1 student, graduated, got the OPT and now I have a full-time job, of course I have a restricted SSN given to me a long time ago when I arrived to this country. Well, we applied for AOS and EAD and it seems that it takes around 100 days to receive the EAD right?

The issue is the following, my current job STINKS, and I want to quit on the 2nd week of Dec, besides that I need some time off because we are having our religious ceremony at the end of Dec. Would that be a good idea?? I applied for a job with a company that cannot sponsor anybody, and can only hire USC and LPR's and I have a good feeling about them wanting to hire me, the job would start on the first week of January enough time to have the party, honeymoon etc etc etc. do you think that I will have any issues in the hiring process since I'm not longer an OPT F-1 student but an AOS pending spouse???

i'm not sure if i understand your concern, but as long as you have EAD there should not be any problems.

05/26/07 - NSC received our application.

06/09/07 - Notice received(NOA dated 5/31)

06/21/07 - Biometrics completed

04/02/08 - case transferred from NSC to CSC

04/03/08 - touched

05/06/08 - APPROVED

05/12/08 - Received Permanent Resident Card (done with immigration untill the citizenship. Will wait till Lithuania and USA gets dual citizenship agreement)

Yes if they will have an issue hiring me if i still haven't received the new EAD, because i have a restricted EAD right now that expires on June 2008. The new job is even related to my major, which is one of the requirements of the EAD and OPT, the question is if the new employer will have an issue...

Well, let me tell ya - it's a grey area... :) But your OPT EAD is still good, so you can work. Sure, one can start a debate that once you've filed AOS your F-1 status is no longer valid and your OPT EAD is void, but it's a legal issue, and employers, or let alone USCIS adjudicators, don't always understand that (I'll go as far as saying - they almost never do). Moreover, even illegal employment is forgiven to spouses of USC's.

So, you have a valid OPT EAD, and you AOS EAD is pending. I'd say you can get a job with your OPT EAD and then wait for your AOS EAD and once you have it - show it to your employer. But they may not even ask :)
