hi,

We were originally going to do the fiance visa route, but for various reasons, were now looking at getting married in the UK.

Anyway, so that would mean doing the K3 route and applying for the IR-1/CR-1 first (if i understand it!). now ive just looked at the I-130 form and i notice that section 14 also (like the I-129f) mentions if your relative is currently in the US.

Im hoping this means I could travel back to the US, then we could put in the forms while I was there and kill of some of the wait together. I know this is perfectly possible via the fiance visa route, and it would be great if this was also allowed on the IR-1/CR-1+K3 route. if anyone has done this, or knows for sure its not a problem, this would help us greatly in finally making a choice as to which path to take :)

If they let you into the US then you can do this. Unfortunately, some POE officers feel that you are a potential illegal immigratn if you come to the US as a spouse of a USC without having your visa yet.

But it is possible to do this. However, it's always depending on the person you get

If you do get married in the UK your other half USC will have to apply for a visa to beable to go to the UK to get married!!

as for you coming to the US then sending your I-130 petition, you would only beable to stay for the 90days the VWP allows!!

so do be prepared to return to the UK & wait for the visa to be processed!!

and ALWAYS tell the truth at POE as if not this WILL come back & bite you on the ####### :yes:

I came to the US for a weeks holiday & got married, THEN i returned to the UK to wait out the visa process, i am currently here on a K3, this took 112 days from mailing to getting the actual visa in my passport, i am returning to the UK for my CR1 interview which is 28th April!!

Good Luck on what ever you decide, just becareful not to do anything considered illegal!!!!!!

EDITED to say....i did visit the US while the visa was processing, you just have to be sure you take lotsa evidence to prove ties to the UK!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

yep, I know i would have to wait out the full time back in the UK, but if we could have knocked off the first 90 days after getting married, this would be fantastic :)

I would never do anything illegal to mess this up, and I only give the minimal responses at the POE and havent had any problems in 7 years of visits to the US :)

yes its a new law, the USC has to have a vis to get married in the uk, maybe you can find the details some where!!, maybe you could go for a holiday get married while visiting as i did & stay for your 90days & file while your there??, but beaware that if you file the K3 if it gets fast approval you might end up returning sooner than your 90days so you have enough time to arrange medicals etc, also you will need a police certificate this can take 40 days to get, so maybe you can apply for it now, as its good for a year!!

hey thanks :) yep ive just been looking into it! this mess of ours is getting so complicated :(

ive looked in the UK visa things, she could get one in 4 working days for £50 if i read right. she had her heart set on marrying over here.

yeah i think we could consider the option of me going there and marrying, applying, staying no more than 90 days :) if i got brought home early, i would be happy, would mean it wouldnt be too long. but as ill be going through texas, i think its gonna be a long drawn out process.

yeah, i have the police forms downloaded already, i should do that, would at least tick one thing off the list ;)

Hiya...right...I am American and my fiance is British. I have been here in the UK since last May 2005. We decided to get married here in the UK and we were under the impression that we could just get married on my visitor visa as well. No you can't lol. As far as it taking 4 working days to get a visitor visa for marriage in the UK..no it doesn't take that long. What you do is you apply online, then make your appointment for the closest British Embassy office to you in America. You take all of your proof of finances, any previous divorce papers etc...and you get the visa that day! I had to fly back to NY to get mine, and the interview took aproxiamately 3 minutes then was told that I was all set and to come back in an hour to pick up my passport with my yellow visa placed in it!! Easy peasy...GOODLUCK!!!

hey thanks for all the info :) all looked fine till you said she had to go to the nearest british embassy for the interview, according to the site, thats LA and she lives in dallas. thats a $300 flight! which we just couldnt afford with all the other costs involved :( thanks british embassy people :(
