RFE from NVC

I called the ARS and got the message saying that on november 15th they sent a letter requesting for documents missing;I called to the operator to find out what is missing she said they need proof om my being in the US she was not able to explain and said to wait for the instructional letter

Does anyone know what can I give them as a proof the only thing I have is visa in my passport the I94 form they took at the airport when I was leaving the US last November

I can't belive this nightmare will never end for us

Service Center : Vermont Service Center

Consulate : Ukraine

Marriage : 2006-11-02

I-130 Sent : 2006-12-11

2008-05-16 CR-1 visa issued

2008-05-20 recieved visa

2008-05-31 I arrived at JFK (took me 1hour and a half to be out of the airport with a stamp in my passport)

10 year GC

2010-03-06 I-751 sent

2010-03-09 NOA-1

2010-03-10 check cashed

2010-4-12 Bio (done early 3-29)

2010-6-3 card production ordered

2010-6-19 10 year GC recieved

N-400

2011-3-28 application sent via express mail to LEWISVILLE TX SC

2011-3-29 application recieved

2011-4-20 early BIO

2011-6-16 interview

2011-7-29 Oath

Are you thinking they are looking for proof of a bonafide relationship/marriage perhaps?

to tell the truth i can't tell you exactly the only thing she said they need the proof that i was legal in the states

No question that you overstayed your visa or anything? It is possible they just misplaced (lost) the I-94 you sent etc.

Was this the only time you met your Husband?

Anyway, if you give all the details I am sure someone will have some idea - but I also understand if you don't want to share. For instance when did you arrive and leave, ie how long did you stay? Was this your only visit, and you got married on that visit etc..

One other thing you could do if you are really curious is to call the NVC back and speak with a different operator and ask for more details, explain you sent your I-94. Depends who you get sometimes, some are more helpful than others.

Question, if they took the I-94 away from you, which they should have, how is it that you have it?

MIGHT BE BUT I DON'T HAVE THE ORIGINAL I-94 THEY GOT IT BACK WHEN I WAS DEPARTURING FROM JFK

I WAS IN THE USA SINCE JULY 2002 ME AND IGOR (MY HUSBAND) MET IN AUGUST 2005 AND GOT MARRIED IN NOVEMBER 2006

If you have I-94 - that is the problem..when I was going to US first time i was told that be sure I-94 will be taken out from passport in other case- although You will be sitting at home , they will be saying that you stayed in US..For some my friends that happened..They were told contact the embassy ASAP if they are at home already..

If they want a proof that you have been to the US:

1. You could scan departure/arrival stamps from your passport and send this (hard, I know, they are rarely clear).

2. May be your plane ticket copies could be requested from the airline?

3. Did you have any credit/debit cards in the US - bank statements would be a proof.

4. Your social security card or driver license. Paperwork from when you applied for an asylum?

5. Lease agreement?

Anyway, pretty strange that NVC would ask to prove you have been to the US. You married, hence you met. Why is it important whether you have been in the US?!

Ah ok, now I am seeing the picture a bit better.

So you were in the States on a J1 (exchange visitor visa) and then you applied for political asylum, which I assume was turned down seeing as you are no longer in the U.S..

Is it possible you were out of status after the J1 expired? They have a copy of your visa so they know you were in the U.S., maybe it is more a question of legal status than just simply being in the U.S.. Again, I would call the NVC and speak with someone else.

Anyway, I am just guessing at this point as this seems like it might be specific to you and also a bit complicated based on having 2 different types of status. Maybe someone has had something similar and will come along and provide some guidance.

as i anderstand the only thing I can do is to wait, because I called to NVC second time yesterday and it was another person I was talkin to she said that my ds-230 wasn't copmleeted right (our attorney checked everything efore sending) she said the questions 2, 3, 20, 22 aren't comleted i don't kow who to believe and theris nothing we can do till we get this letter from NVC hope it won't take too long to get it
