Im curious about the 1-way ticket (1) month before you got married. You really intended to return, right? :innocent:

Curious.... why did you one have a one-way ticket?

stupidly i had a one way ticket cos it was cheaper, didnt know it would cause such a problem, we had no intention of becoming married, maybe 2 or 3 years down the line, but not at the time

Hello, and you wonder why USCIS is barring you for 5 years? After reading this post, you do not seem to be telling us all you did or attempted to do in POE in Detroit. You had a B1, then tourist visa and you try to enter with one way ticket, after marrying a month before in Canada? AND then you are in Dublin, Ireland which is known for IRA terrorists, and Canada is known to have very liberal lax immigration laws, which are often used as a conduit for entry into the USA for terrorists. What did you think would happen when you pulled that stunt. You were breaking the USA immigration laws plain and simple, they were doing their job in the eyes of Dept of Homeland Security. Best of luck.

Completely untrue. Have you tried to immigrate to Canada lately?? It's not as easy as you may think. Oh, and the terrorist thing is a crock too.

Methinks the OP got some helpful advice in this thread, were your comments necessary?

My husband is kind of in the same situation as yourself. He was coming in December last year to be here for my graduation for trainning to become a supervisor and for my promotion. We actually did intend to marry also in Vegas but intended to file all the legal paperwork required for him to live here. He was in the Visa Waiver Program. When he attempted to come through the POE in Dallas, he was questioned about his intentions in the US since they also saw that he was bringing his two cats. Of course we both did not know at the time or read about immigration laws and assumed that he is able to come visit whenever since he has a couple of times before December 2006 to visit me, as long as he does not stay here for over 90 days. He even had a roundtrip ticket and intended to return due that his brother passed away last summer and he wanted to check up on his family while we would process his paperwork! They stamped on his passport:

VISA WAIVER PROGRAM REFUSAL pursuant to 8 CFR 217.4

My husband bought his own ticket back home and was detained at the Dallas county jail until his flight left since they had no space to detain him in.

I called back the immigration officer, who called me earlier that day to question if I knew my then fiancee and his purpose in the US, to see if he is able to come to the US after being denied. The immigration officer told me that as long as I file a K-3 Visa he should be able to come into the US to marry me. Screw that. I went to Germany, got married and filed the I-130 and I-129F. I am nervous about his inteview because I am sure that they will question him about that incident, but Im sure that they will understand that we did not know. No one explained to him the Visa Waiver Program regulations and limitations. Any how.

Does anyone know if we would have to file a waiver to for this? :wacko:

Cassie is absolutely right, I don't want to hijack the thread by getting off topic here, but you are really quite out of line zqt, not only are your comments wrong, they are also not helpful to manda.

Canada does not have lax immigration laws, it is also not commonly used as a conduit for entry in to the US for terrorists that you or I know of, unless you have some inside information on the U.S./Canada border?

I don't know but from all the above info you just never know what might be in your records after you've been denied entry....best to find out and have a waiver/waiver application ready for the interview!

07/20/07 confirmed delivered by US Postal Service

8/23/07 No NOA1 !!!!

8/23/07 phoned USCIS (told they can't help until after 90 days)

8/23/07 contacted bank to get copy of Cx check...illegable...noc WAC#

tried for weeks to get actual check....not possible, had to wait the 90 days for info from USCIS

10/17/07 Phoned USCIS, got thru (!), got WAC number and NOA1 date!!!!

07/26/07 NOA1 (never recieved hard copy, was promised a copy would be sent)

11/01/07 Ordered copy of "long form" UK B.C.

11/05/07 Recieved B.C. (Wish USCIS was that fast!)

11/09/07 Submitted request for UK police records

12/04/07 APPROVED By USCIS NOA2 letter sent (or so they claim)

12/15/07 Police certificate recieved

12/28/07 Called NVC, not in system

01/04/08 petition forwarded to London

01/12/08 packet 3 received *rubs eye in disbelief* Speed and efficiency, can it be?

01/18/08 HARD COPY OF NOA2 ARRIVED...seems the snail made a wrong turn somewhere.

01/28/08 Returned packet 3 to London Embassy

02/12/08 Medical completed...no problem.

02/13/08 Packet 4 received from London Embassy

03/03/08 Embassy Interview

03/06/08 Visa Arrived....Lovely to finally see it even if it is a bit drab...after 8 month you think they'd have sprung for some gold foil or at least a COLOR photo?

TODAY...he's here! He's in the US! Hurrah!

Was just reading this thread and was wondering about something and yes Im sorry for your situation.

Since I am a frequent flyer as many of my mates are also, I know of no one that can travel to another country without a round trip ticket in their possession. Maybe its differnt in your country, but I do not think so. I believe that you must have a round trip ticket in order to do that, could be wrong, but have been told this many times from different sources aka, lawyers, flight agents, customs etc. No I have never done that for my intentions are always to come home on a certain date.

Just curious and again sorry for your situation. Hope you sort it out soon.
