They can't deny your AOS based solely on an age difference, but that doesn't mean that the age difference can't cause them to give you extra scrutiny.

An attorney might be helpful for the next interview, because it's nice to have a disinterested party there to say 'that question is out of line.'

I'm simply a giving him an option, if he wants it he can take it. Lets face it, it is out of line to ask questions about sex on an immigration interview. Beside, if he goes to his congressman they can advice him and his wife as the action which to take. We went through the same thing and we did not do anything we had to wait 2 more years just for another interview. We are not here because we are "disinterested", we are here to support each other, a "disinterested person" would ignore the question and not bother to reply at all. A lawyer or an immigration specialist (like the one at your disposal at local congressman office) is going to advice them and point them in the right direction. Actually it is quite common for sex related questions to be asked at some interviews.

A guy I bought one of my cars from was from India, and became a USC. He had an arranged marriage to a 22 year old (he is 37) so when they went through the process they were HEAVILY scrutinized and asked a LOT of personal questions.

And I guess I'm paying the price for people like him. :angry:

We're not going to take the bullshit. The officer said we should get a letter within a month, if it's not here within 2 months, we're going for the congressman inquiry.

Our lawyer said that after the 2nd interview they have to either deny or approve us since they found nothing wrong with our case. So our lawyer is coming with us for the second interview, what for? So that they don't break the law again. There'll b will be no lame excuses on why they can't approve us because of their moral beliefs.

It'll probably cost us $1000-2000 depending on how long the interview takes.

A weird thing that happened and my wife is worried about:

He asked me why I chose "Mr. Cella" (my lawyer) ?

I answered and then asked him, why is he good? His answer "I don't know"

I don't understand why he took my I-94 either. I thought that if we're not getting approved, I got to keep my I-94. When I asked him he said "Yep, it's now property of the US government." And he also asked us to pick a pic of us to put in our file.

I'm not sure why you think you're disagreeing with me, but I can only conclude you're reading things that aren't there. "Disinterested" doesn't mean "uninterested"; it means someone who is not personally at stake in the process and can therefore advocate for you free of self-interest. A lawyer counts as someone who has nothing personally at stake; you saying 'I'm not going to answer that question' is a lot harder than your lawyer saying 'Under law she doesn't have to answer that intrusive question.' Hence my advice to get a lawyer.

According to a RL friend, sex questions are ones that the couple can refuse to answer. Their main purpose is to try to rattle the interviewee (harder to lie if you're startled.) When they went for their AOS interview about 5 years ago, they took along a lawyer whose sole purpose was to say "She doesn't have to answer that" when asked about sex. If I understand them correctly, it's sort of like when the cop asks you to pop the trunk; you don't have to, but they're not going to tell you that.

Overall it was much easier than I expected. The officer was actually a human being just asking questions. Here's how it began:

He asked my (USC) questions about me for about 5 mins. Then he asked me a few questions.

Then he said I'm going to question you separately and I usually begin with the USC. So my wife was questioned for 10 minutes. Then he questioned me, had me instruct him to draw a diagram of our bedroom, where the dressers are, the bed, etc... asked about our pets and the last question was about sex which in our case it's a complicated answer but both my wife and I answered the same.

He brings my wife back and then he disappears for a minute and comes back. Here's the deal, you're great people and you answered everything correctly. However I have a problem with your age difference so I'm scheduling you for another interview but don't worry about it, you'll be fine, just do like you did today.

I didn't go there expecting to get approved on the spot, due to our age difference I figured they'd come up with a technicality or RFE so they don't approve us on the spot. But both my wife and I are angry (but not overly, I prepared her yesterday and told her the chances of an approval was low) that the officer basically told us he's discriminating against us because of our age difference.

PREJUDICE = The outcome of our interview was pre judged before we even got there. They have the power. Is it right?

We'll just go to the next interview. If there's more BS we'll just have to contact congressmen/senators.

He did take my I-94 and asked us to pick a picture of us together...

I really don't understand how they can ask you about such a personal thing as sex between the two of you. Is that appropriate for the USCIS interviewer????????????!!!!!! I think if they do that when we have our AOS interview, I will file a formal complaint with the USCIS about the interviewer. After the green card arrives, of-course! I feel there are plenty of ways to prove a legitimate relationship other than asking about such a personal thing! IT really makes me angry! I admit I have not read all of this thread, ( I will tomorrow), so maybe I have missed something.

Well, I just came back from my lawyer, I had a few questions to ask him about my case. I remember you case and I asked him once again, if sex questions on an immigration interview were illegal because I heard that it is very common to ask those questions. He answered that all they can ask is questions about the i-485/i-130, affidavit of support, and some question about the marriage but that sex and religion questions are illegal. He said that if you would have had a lawyer with you they would never ask those king of questions. Just a little information for you guys that think is normal for an immigration officer to ask those kind of questions :secret: .

Wow that's pretty nuts. Since you already had to Stokes interview right away I don't see why they need to schedule a second one. What else are they going to ask?

Good luck for the next one, hopefully it will come soon and you'll have your lawyer with you so it should be more fair.

I can only pray they don't ask any sex questions because my husband would love nothing more than giving them a shocking 15 minute detailed speech about it.

As for the age, we're 15 years apart! He's 23, I'm 38. We don't think about it and we don't look that far apart. He looks a lot more mature and luckily I look younger. I don't want another thing to be worried about :(

the hell is loose in the east coast i guess ...

i have not been around on here due to my interview experience that got me pretty angry as well!!! and just like igomo i have been told by the asian female officer that she doesnt believe our relationship is real cuz my husband has been arrested back in his younger days and did the time he owed ... she even went as far as saying she doesnt understand why i would be with him and to add on to it he is african american and i am white .... ggrrrrrr!!! oh yeah at least she was friendly enough to give us another appointment in aug 2008 .... one of her very first questions was if i was arrested and then she asked my husband ... after that it was it .... she never looked at ANY of our evidence and kept riding around on his criminal record n past .... i am furious!!!! he has put all this behind and changed his life and btw what does his rap sheet have to do with our marriage??? why can i not love a person that has done a mistake in his past and paid for it in full??? who is she to judge him/us and actually put punish him again ... :angry:

Thanks for all the great info and concern. I'm sorry some of you had to suffer discrimination at the hand of the officer like we did.

One thing I'll say is that my lawyer did say our case is perfect but that just because of the age difference he'd recommend his presence at the interview. I declined only because of financial problems. But I think we would be approved by now had he been there.

Since both of us is working now, when the next interview arrives we're bringing him so that they don't cross the line. He says next time they HAVE to approve us.

That is outright unacceptable. He is not supposed to ask you any questions about your sex life/activities. Maybe he did it for getting his kicks off. LOL Make sure you bring your lawyer with you next time, so he can tell you what you can and cannot answer. Good luck with those buffoons.
