I highly doubt it was illegal. The interview isn't to make you comfortable. If they suspect something, they can't just let it go.

Saying something along the lines of "I'm not happy with the age difference" seems on the side of discrimination. Where in AOS does it say that spouses have to be a certain amount of yrs apart, no more no less? Love is crazy, its not for them to judge the age difference, its for them to judge the merit of the marriage and if it is true & geniune. According to the OP it seemed the officer had no issue with anything else.

I think discrimination of any kind is pure ####### and that age should have no factor whatsoever in any decision.

That being said, too many people have taken advantage of this process too many times in the past. Yes, it sucks. And, yes it is unfair to those who are legit and trying to go about everything the right way. You can thank some of those scum before you for most of the hassles we face today.

If the agent was suspicous that due to the age gap this could be a fraud marriage, he should have worded himself better.

If you don't mind me asking, what do you mean by sex question? Which questions relating to the intimacy of the couple can an agent ask? I wouldn't think asking how often or which is your favorite position would be something accepted, is it?

My lawyer said he never heard of this happening. He never even heard of a couple being separated on the first interview. Yet when he said he'd separate us we didn't care and we got everything correct during the unexpected stokes, I'll try to list what he asked of us during the stokes:

Show me where everything in your bedroom is, and then he drew it on paper.

What kind of floor is in your bedroom?

Do you have any pets? What are their names? We have six cats, we gave them all the names.

Did you shower this morning? Did your wife?

How did you get here? Who drove? What car do you have? What roads did you use to get here?

Did you have breakfast? Did your wife?

What's your favorite sports team?

What was the last movie you watched together? When?

What did you have for dinner last night?

Does your wife use any sort of birth control?

When was the last time you had sex?

So you like cats? He had a big smile on his face and said he's a cat person too.

He asked my wife some questions (when we were separated) about me. He asked her to list 3 adjectives to describe me and he then asked her if there's anything that I did that stood out in her mind and she told him a story about me rescuing some kittens outside (who are now 3 of our cats). She said he really showed his human side then.

Then he brought my wife back he disappeared for 1 minute. When he came back, he says:

"You're great people and you got everything correct but I got a problem with the age difference so I'm gonna have you come back for a second interview"

Me: "The age difference huh?"

"Yes, I have a problem with the age difference. You're great people. Don't worry about it, the interview will be just like today, you'll be fine"

I didn't really care at first but the more I think of it the more angry I am about the discrimination. My lawyer told me not to challenge or argue with the officer so I just accepted whatever he said. Had it been any other situation I would have flipped out and gone off because one thing I can't stand prejudice and discrimination!

The problem with the sex thing was that we had to say more than we wanted to. What is sex? When Bill Clinton said he didn't have sex with that woman, it was wrong right? So neither of us wanted to get it wrong because of a technicality. And one thing leads to another, my wife is happy that it proved to him that we didn't have rehearsed answers but I'm not happy I had to address my sex life with an immigration officer.

Congressman have a staff to help them with their workload.

I did not speak to my congressman but with an immigration specialist working on his behalf. She was very understanding and proactive. She immediate contact someone at the USCIS and wrote them a letter(asking them to reopen our case) and faxed it along with some of my letters. She also wanted to investigate that lady from our fist interview but we did not have her name nor any copies from when she interviewed us. We should be hearing something from the USCIS soon. I guess you could also contact a senator.

Thanks. I think well go that route since the only reason given to us was the age difference. Also my wife has spamodic torticollis (like parkinsons but it affects the neck area) and she had to take extra medicine for the interview. Medically she cannot withstand a couple hours of being interviewed.

They can't deny your AOS based solely on an age difference, but that doesn't mean that the age difference can't cause them to give you extra scrutiny.

An attorney might be helpful for the next interview, because it's nice to have a disinterested party there to say 'that question is out of line.'

The problem with the sex thing was that we had to say more than we wanted to.

I talked with a friend, whose sister went through the AOS interviewing in the 1990s. He said they were much more open to asking this type of stuff back then. They had a similar stokes interview as the first one. He didnt mention if they were split in separate rooms, but did say the officer went kind of graphic into questions of when is the last time you had sex, how often, what color panties did your wife wear this morning, asked to see their house keys too see if they did match up, what did you eat for dinner last night, who prepared it, etc.

I guess they want to see how you react under pressure. But definitely agree Igomo, have your attorney there the second time. Keep us posted how everything goes, I'm sure it will go well 2nd time around. Be positive. :)
