They are likely to give you that response if your I129F has not hit 6 months. Also, getting RFE'd sort of starts you off on a new clock of sorts. They say on the RFE that they will give you a response within 60 days of receiving your response. They never promised to give you a final approval or denial within 6 months of NOA1, but they did get into adjudicating it within 6 months, then they get a new clock for RFEs.

In a previous life, when I was RFE'd on a petition, they had started adjudicating it in 2.5 months, then gave me a response exactly 60 days after the RFE when I called on day 60 they said they sent approval that day; so actually it was all under 6 months.

I received my RFE on November 9th asking for more pictures of my wife because the two photos I sent of her were to BIG. Until this RFE was sent to me, I heard nothing from USCIS, only that my I129F had been transfered back in June. So it took USCIS 7 months to let me know my photos were too big. I have mailed my new photos in which the California office has received on November 14th. I called to ask how long the photos would take to be recognized with my petitions, and USCIS told me to call 2 TO 3 WEEKS LATER. I have written my governor, senator, and 2 congressman,and a State Rep. I received an email back from the governors office saying that this issue was a federal issue to contact my congressman. I received a call back from one congressman's office, and they said my case was still within USCIS time frame. The others I have received a typical form letter stating the got my email. I had to stop looking on VJ because I was getting way to upset knowing others had received their RFE several months ago. And I also have a friend who filed only the I130, after I filed both of my petitions, needed RFE, and his 1 petition is at the NVC already. The frustration sets in because I feel helpless, and I can only hope that they approve our petitions soon.

Hi Everyone,

still nothing for us poor people who are still waiting past 180 days?? I got a letter from the Vice President's office saying they will look into my situation and forward it to the Dept of Homeland Security (responsible for USCIS).. they want for them to deal directly with me and want a copy for their records too =) Also, two congressmen have contacted me and is trying to help (nothing from Senators yet.. they are the ones I hear can really help)..

3 different types.. what the $#%#? If I barely get past the 1st check after 8 months... then 2nd check will take another 8 months at NVC??? and also the dreaded "AP" (Administrative Review) at the Consulate??

But cannot offer any more info... was told to call back in 30 days.................. Am I in a Spinning Black Hole of the USCIS?

you know what just happened? They sent me a "REPLACEMENT NOTICE OF ACTION"... that is so retarded.. they thought I had lost the 1st one.. I didn't lose anything :angry: I was told to keep everything together.. not like what they are doing... that is so ridiculous.. I just got another "NOA1" through the mail (because of my call on Thursday to them to follow up on my I-130 or I-129F)... they are the most stupid people.. then they said that my application will be approved "late this year to early next year"... what the $@)(%#)% is that?

I feel your pain Gogo!! I'm so upset today and I can't concentrate! I have emailed the Congressmans office and the Senators office and I'm waiting for a response. I'm trying to keep it together but, I'm coming apart... In our case its one document and they are delaying our approvals and its not fair!! I've been thinking of making an appointment with USCIS in New Jersey because I can't take it anymore...

I just called at 8am... they said my application is going through a "background" check this time and most of these checks take about 2-3 weeks (exact time uncertain).. they said someone is looking at my I-129F form already and is will be approved immediately once this background check is over... so 2-3 weeks??? :crying: that would be give me an estimated date of 12/7/2007... I'll give them this delay this time... they said I called too much.. 6 times in 2 months... they said to try to limit to 1 per month... Next call will be 12/7/2007 then..

Don't forget, Thanksgiving is in there too, might delay things by a couple of additional days.

I looked at there for processing times and USCIS have not changed the date to November 2007. They are always stuck behind.....
