I am the foreign fiancée so I'll be the one having the interview at the embassy. In the list of things you need, it says divorce papers. I've never married but my fiancé (the USC) is divorced. Do I need to take his divorce papers to the interview? It also mentions marriage certificates... for the I-129F application we only needed to submit the divorce papers.... will we need his previous marriage certificate too? It seems from the wording that these papers are only necessary if I'M the one who was divorced, but I want to make sure.

31st August 10 - NOA1 from VSC

10th January 11 - I-751 approved!

14th January 11 - 10-year green card in hand!!

22nd April 23 - N400 submitted online; NOA available in USCIS account immediately
6th November 23 - Interview; approval same day
28th November 23 - Oath ceremony scheduled

am not sure about the marriage cert we didnt need it , but yes you will need his divorce pappers even if he is USC , they require divorce pappers from eather petitioner or benefitionary if eather was married before

I'm the USC (and the gay divorcee!) and whilst we took my decree absolute to my UKC husband's interview in London, they did not want to see it, even when I asked them if they had any interest in it. They said they had already seen it during the I-130 process. At no time did I ever produce a copy of the certificate for my first marriage, not during the I-130 process or at the interview.

Now, this may not be the same for Amsterdam, so I would bring the decree along if I were you. :)

It's good to be prepared with all the things they might ask for but don't expect them to ask for everything.

If often the K1 applicant is required to bring a certificate of single status or not married status but this varies by Consulate. They're very practical about it in that they don't require them in countries where they aren't actually obtainable.

You will need a certified copy of the petitioner's divorce papers from the court.

We did need the decree absolute at the I-130 stage (when I was the petitioner), but not at the Embassy stage. If my UKC husband had been married before, they would have asked for his decree absolute at the interview. As this was his first marriage, they only wanted to see the marriage certificate at the interview. Again, it's always better to be safe than sorry and bring it along, but don't be surprised if they don't want to see the USC's divorce decree on the day.

They, (the embassy) required me (the USC) to give her (the beneficiary) an original divorce decree with the seal of the court. The requirements DO vary by consulate however.

Sorry for the delay in getting back about this... thanks for the replies so far. Well my fiance has the certified divorce papers so I can get them from him. I think it's weird that they ask for the marriage certificates as well... surely if you have a divorce paper then there was a marriage at some point?!! Anyway it looks like we'll need to get copies of the marriage certificates as well, just to make sure. You never know what these COs might ask for...

Marriage certificates help establish a paper trail of name changes for females. Since the only person previously married is male, I wouldn't worry about a marriage certificate for your K1 process.
