sorry if this has been asked already somewhere! i've tried searching..

so i'm putting together the affidavit of support and it says on the paper to check:

X "I have filed a Federal tax return for each of the three most recent tax years. I have attached the required photocopy or transcript of my Federal tax return for only themost recent tax year."

I can attach the photocopy of my most recent tax return... but I have NOT filed for all three years. I filed 2004 and 2006, but not 2005. Can I still check that section? Is there anything extra I should do? Like attach a letter explaining why I didn't file (I spent the year traveling, and not working) Do I need to wait to file AOS? HELP!

I would not check that but would bring to the interview both with me, I highly doubt you will be asked about it, because not many people get asked about their income almost 3 years ago... and plus, that part is optional anyway, you are only required to provide last year.

I was required to provide 3 years of my most recent tax returns for AOS. Wasn't optional.

May be because of me being self employed.

Attach a letter saying why you didn't have to file 2005.

As Florida said there's a good chance you won't be asked for it anyway if you have all your other"ducks in a row".

But have your butte covered anyway.

Here is the truth on this, it says optional, which is keyword here and many on here will argue that you do not have to send or bring more than one year's worth of tax transcripts or returns or supporting W2s and 1099s, USCIS says that on the form but reality is they expect all three years worth of most recent tax returns, and I am sure you are going to have others post on here I am not right it says optional and all this about misinformation, but think about it why do you think the USCIS go ahead in line below the most recent tax return check box and say optional for next two years worth. Later on they will ask for it more than likely later to prove you are stable and able to provide above poverty income to support beneficiary and not become a government charge. I think you are right in doing what you suggest, attach a letter or note explaining what you have available and why you were not required to file in 2005. Also helpful tip, send in photocopies or bring them with you of any 1099, W2s for most recent tax return and any supporting schedules, for they do look at those also. Good luck.

Hi Sereia! :) I was confused on what to do too, because 2006 was the first year I filed tax returns in my entire life (I was in India for over 20 years not making enough income). What I did was this: I checked the box, but crossed out "three" with a black pen and wrote in "one". Then in the line below, I wrote in the earnings for 2006. I enclosed a letter of explanation and the first three pages of Publication 501, "Exemptions, Standard Deduction, and Filing Information for 2006" highlighting earnings needed to file - found at http://www.irs.gov/pub/irs-pdf/p501.pdf

I also enclosed W2s and 1099's for 2006, they are paticular about having those! AND I sent in tax transcripts ordered for free from the IRS, they checked a box saying I had not filed for the other years.

Happily, I was not questioned about anything, and I did not receive any RFE, and we got the instant approval after the interview. Here's wishing you a quick AOS approval! :thumbs:

I am sorry I am not as knowledgeable as you are in this matter, so by all means go ahead try it with only one year and do what you have said to do, since you know more and are an expert, best of luck, forgive me for I had no idea.

It is not about knowing more or less than others. First of all, you are dealing with SERIOUS stuff here on this board, we are not playing to see who knows more or less, our advice can RUIN someone's AOS, therefore we need to be extra careful when giving advice. This isn't about what you THINK is required or not, it is about what the USCIS thinks is required, they play the music and we dance along and they do NOT (nowhere have they indicated otherwise) require you to bring tax returns from your last 3 years, they may ask for it, but they don't require you to have it. I mean, they can ask for anything, really.

Also, your attitude is what is frustrating people around here, first the HIV thread where you were extremely mean, then others and now this one where you feel like you hold the truth, even though you don't know what you are talking about. Just remember, our advice can ruin someone's life, so take it serious and if you want to answer questions here, do a lot of research. 99% of the people here aren't attorneys, we knew nothing at some point, we know what we know by experience and by researching.

All right, that's enough. Any more snide remarks will get this thread a lock and no key!
