Pushbrk - this question is indeed one that can be answered and is not as open & shut as you may like to present. The OP has noted some serious potential problems (and might I add others have gone through a consulate where they have been living illegally and come through just fine) however outlining potential reasons why someone can be refused a visa is individual depending on factors at play (which is where discussion can be quite helpful!)

I would apreciate you taking care with some of your posts, you can be respectful while at the same time providing direction and education.

Not that it matters all that much.. because I have done what I can do.. but how is a case rejected? or is it too vague to answer

Reasons to deny a visa are very specific with the exception of fraud question, is there a bonafide relationship? That is the only question that is up to the CO's discretion, everything else is pretty clear cut.

Do you pose a health risk?

Are you a security threat?

Are you likely to become a public charge?

Have you ever used drugs?

Have you ever committed a serious crime?

If you can answer no to all those questions, than the only thing you have to worry about is proving that you have a bonafide relationship.

no i have no reason to think it would be denied. I have a buisness, I made well over the poverty level. I am totally in love and vis a vis my fiance with me( he loves me very much) I have been to Italy three times this year to see him. I just dont want anything to go awry and wanted to see what wss the deteminant..This process makes you panranoid.. It least it does for me.. I was almost ready to go live in Italy, because it took them 45 days just to cash my check...

Thank you for your advise.. I did not mean to offend anyone with my question. I am just a bit paranoid(the process already seems to be very long) and would like to be prepared as possible for any problems..

To prove my bonafide relationshiop I have been three times to Italy to see my fiance Salah, and we speak a couple times daily. This process is just so daunting..Thank you again

I wasn't offended by your question in the least. You asked out of paranoia, not mischief. The result is the same and the answer is study and preparation, IMO. All you can really do to impact the result is to carefully prepare for the next step in the process and/or respond to correspondence accurately and completely.

The time between filing and petition approval is the most stressful because it totally a black hole with no way to accurately predict the timeline. There are just too many variables outside our control.

Facts are cheap...knowing how to use them is precious...

Your trips to visit your fiance (provided you can provide documentation to prove they occurred) are great evidence that your intentions are sincere. If I were you, and with the limited information you have provided, I'd be making sure that my fiance has a way of demonstrating to a CO at an interview that his interest in and intentions towards you are also sincere.

What effort has he made in the relationship?

Has he taken an interest in you to the extent that he is fairly familiar with your family and your life and can answer questions about names, places, employment, interests, your past, your family, etc...?

These are the things a CO might be interested in checking out.

Just to clarify......

There are two steps to the process.

The first is approval of the I129F, which is fairly rudimentary. It requires proof you have met in the last two years, that you are both free to and intend to marry, that the petitioner is a USC, and a few other minor clerical details.

The second is the consular phase. This is where the bonafides of the relationship will be reviewed by the consular official, as well as financials of the sponsor and the health and criminal backgound of the visa applicant.

It's important to be aware of what each phase requires and prepare accordingly.

As for the knarly attitude of some who think they know more than others, it's best to search around those posts. The information they have to offer is not worth the abuse.

Please pay special attention to describing all possible dangers to which these stupid sheep might be exposed. Oh, and I'm not going to tell you anything about my flock, its location or what is already in place to protect them.

Please do this on your own time because I'm not paying for training.

Wow, that was kinda mean. Most of us go into this process knowing next to nothing about it. Some of us are better at researching our questions a little better than others. Some of us are more nervous than others, and some of us are no quite as good at verbalizing our questions, especially when so much is at stake. But none of us should be above helping someone out who is asking an honest question, even a question that's to vague. Or if we are above it we should have the grace to just move on to the next post.

I answered the question posed in the post I quoted by clarifying the question. You answer your way and I'll answer mine. Your response above is completely off topic.

There is no answer to the OP's question. It's like asking how to build a suspension bridge. You might be able to learn about it on the web but the answer will come from a previously published "Guide" not a group of civil engineers, asking how much of the bridge is already built and what problems have occured, then listing a thing or two each that might go wrong in the future.

His questions are best answered by studying the guides, determining which issues might potentially problems in his/her case and asking specific questions that apply.

Thanks for clarifying Rebeccajo... I was assuming (uh-oh) that the OP was at the Consular stage, but I see now she is waiting for I-129F approval.

True and true... from my standpoint, the point pushbrk was trying to make is that this is a public forum and one must be careful as to what they say. If I'm wrong on this point, I'll make one of my own: this is a public forum and it is accessible to non-VJ's whether they are on this journey with us or if they are using this resource for their own malevolent purpose. BEWARE.

Really, there is no such thing as a stupid question. But in the interest of integrity, we must watch our words. Perhaps it's paranoia, but I'd prefer to be safe instead of sorry.

You know I am really sorry I asked the question. This forum sometimes feels like the KGB instead of an understanding place where we are here to help each other. Once my fiance are here together, I am commit to help people such as myself with the same "stupid" questions that I asked. I promise not to look to this forum again for support. Just to my friends and family who understand the stress I am ( and most of us) under to get my fiance here to the US with me.
