is a refusal under 221(g) of the immig law act, and request for further evidence the same thing as a denial

No, you must look at what the paper says, that you received at your interview. Usually they request further evidence to satify said section of the Immigration and Nationality Act (INA). Either financial documents, or more evidence of the personal relationship....depends on what the interview was like.

You have up to one year (I believe) to respond to a refusal under 221(g) before it then rolls over into a denial and your petition is send back to USCS w/ a recomendation for a denial.

Did you or someone you know get such a refusal? This refusal must be answered to the satisfaction of the consulate before they will issue the visa. Please provide a little more info, and perhaps other VJ-ers can help.

Nope! You are on AR.

You have to provide them with what they asked for unless it says "Wait until you heer from us" at the bottom.

Then you just have to wait. You can try calling Lorraine at the USEM also.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Oops ! Looks like you are on AR for late BC registration.

If so!

Here is a list of evidence a friend of ours submitted when she was put on AR for late BC registration.

Took her 4 months to get her visa.

1. Old and New identification (ID) cards (i.e. school, employment, driver's license, ATM's, credit cards, PRC, SSS, BIR).

2. School Records (i.e. certificates, diplomas, registration/report/class cards).

3. Class Picture and Year/Annual Books/or Souvenir Books

4. SSS E-1 and E-4 Forms (must be original or certified copies from SSS Head Office).

5. Original Baptismal Certificate

6. Photo of Baptismal Registry Book, which includes the Book Cover, Prayer Cover and page on which appear your name, date of birth, date of baptism, name of biological and Godparents, ( picture size must be 8 X 11 inches).

7. Employment and/or income tax record ( OLD and NEW)

My wife was late BC also and took most of the above with her to the interview to support her late BC registration.

She didn't have any problems!

Ingat!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Sorry to hear you had a problem. My wife was also late registered and didn't have a baptismal certificate but she brought everything else Haole mentioned above and was approved. Hope your issue is resolved quickly.

i was denied under section 221 (g) and they were sending my case back to uscis via route to nvc but my lawyer made it stop in embassy
