Timeline

As the interview date approaches, we have 95% of everything in our accordion folder ready to go. The last thing we do not have however are the last 3 years taxes for my wife and my co-sponsor (my mother in law). We have last years though photocopied.

Is this an absolute requirement to have? Getting transcripts can take time and I am worried like last time it could take a month+ before we finally get them and maybe something goes haywire and we don't at all.

Feedback, opinions?

I believe all they REQUIRE is the current year's returns. The other 2 years of returns I thought were optional. If you have 3 years of returns, by all means, take them with you! We never had an Interview.

July 18, 2007 - Biometrics completed

July 20, 2007 - Case transferred from MSC to CSC

July 31, 2007 - AOS Approved - 57 days - Without an Interview!

Aug 06, 2007 - Received Green Card in the mail today!

Jan 8, 2009 @ 8:18PM - Our son was born tonight !!

I-751 - Remove Conditions

July 11, 2009 - Certified Mail to VSC I-751 Package

July 14, 2009 - Check cleared bank

July 20, 2009 - NOA1 & 1 yr extension - Receipt date is July 14. Case# assigned

Sept 1, 2009 - Biometrics completed

Nov 25, 2009 - I-751 is approved. No Interview.

Dec 14, 2009 - 10yr Green Card arrived !

I believe Joeyjoey is correct that only the current return is required. I would still try to get the other returns just incase. Call today and request the free copies of the return from the IRS, its an automated system.

I had to get them twice, both times they all arrived within 10 days. This was in Jan and June of 2007. Also, If your wife or mother-in-law filed their taxes online they should be able to log in and reprint prior tax years. Also, if they used a tax professional, I think they should also be able to reprint those returns.

They ask for and expect three years worth, it was in the directions, now we get to find out if you can get by without following their rules, interesting.

Where in the I-864 directions does it ask for three years' worth of tax returns? As far as I know, it only asks for the last recent year with the option of providing the next two recent years.

I don't know why you feel the need to be so unnecessarily condescending.

It said in our appointment notice they wanted the last 3 years for the AOS interview.

I'm self employed tho and that could make a difference.

Bottomline is get them!

More ammo the better!

They won't slap you on the hand for having them. But if they ask for them and you don't have them!

OH MY GOD... you are the king or queen of ASSUMING things and speaking about something so surely even though you have no idea what you are talking about. All the posts I see from you are full of "know-it-all" attitude...

Show us where on the I-864 it says that 3 years are required. You won't find it, you know why ? Because it is not required. The last year is required and the previous 2 are optional.

You might want to considered doing some research before posting here, because you are looking like a fool.

No one here knows what is "absolute" without a doubt!

Go what has been successfull for others and don't try to "cut corners".

Try having the tax transcripts faxed to you. Others have done so in a couple days.

Took me 7 days thru snail mail!

Maybe yours will be faster this time.

Doesn't cost anything to try! Plus IRS is open 24/7.

Excuse me, but the instructions are very clear and they state that you do NOT need 3 previous years worth of tax transcripts, it says you must only show the return from the previous year and the two other years are optional.

Please let us see those specific words! May be things have changed since we did ours I was REQUIRED to have 3 years of tax returns. Not tax transcripts as you say tho!

When in doubt, follow the instructions on your interview appointment letter.

Great advice and you are correct but you are going to find many on here will not follow directions of USCIS or will try to make up the rules or read into them what want to go along to fit their agenda, which oh well go for it, it will be interesting to see what happens.

Read the form and directions for the form, it is there in black and white, no hot air, just honesty, like I say do what you want, it will be interesting to see what happens.

No I just follow the directions and rules of USCIS forms, that is all, and honestly, think about it, if it is optional then why does USCIS ask for or offer it optionally? They expect it or they would not have even give it as option, they would just say one year worth, and that is fine go ahead do what you think is best for you by all means hope it works it will be interesting to see. Thus show me where it says you do not have to send in those returns, it is a poorly worded form with directions on that I864 that confuses a lot of people, and a lot of people have gotten RFE over this optional check box and then asked or directed later to resubmit all three years worth. But like I say go for it, try it, will be interesting to see what happens, maybe they have changed their minds now, who knows. Best of luck.
