Hi there,

I'm in a similar situation to what you are in. I came here on a vwp and stayed on but married within the 90 days. Actually if I recall correctly it was 4 days before it expired. We know that adjusting from vwp is not highly thought of so we have an immigration attorney to help us do the process through DORA in Dallas.

With regards to the wedding, we had a small ceremony with just my MIL at the local courthouse, as we plan to have a much flashier wedding next year when all this AOS palava is over and done with.

I-130 for both parents

March 28th 2013 - Priority date/ NOA 1
November 14th 2013 - Transferred to Nebraska Service Center

January 7th 2014 - Case changed online to approved for both

January 8th 2014 - case changed to shipped to NVC

January 9th 2014 - case changed to NOA 2 mailed

January 10th 2014 - Received the hardcopy of the NOA 2 stating that NVC would issue a case number in 30 days approx.

January 21st 2014 - Case Received at NVC

February 26th 2014 - Case numbers and IIN number received - Wrong embassy code assigned...now waiting for new case numbers.

March 3rd 2014 - Filled in DS-261 for both parents

March 5th 2014- AOS available, paid and submitted AOS packet.

March 6th 2014 - USPS shows packet was delivered at NVC

March 10th 2014 - AOS shows as paid in the CEAC portal/AOS logged into system as being received by NVC.

March 11th 2014 - New case number assigned for my Dad.

March 20th 2014 - Paid IV fee for my Mum.

March 25th 2014 - AOS accepted by NVC with no checklist.

March 26th 2014 - Filled in and submitted DS-260 for my Mum

March 31st 2014 - AOS found in my Mum's file for my Dad - accepted and placed into his file/IV fee available for my Dad and Paid.

April 1st - Mailed all civil documents to NVC for both parents.

April 3rd: IV fee shows as paid in portal/submitted DS-260 for my Dad.

April 22nd: checklist issued for civil documents - NVC error ...

April 23rd: sent another certified copy of my marriage certificate

April 24th: Case complete! :)

April 30th 2014 - Medical scheduled for parents at Knightsbridge in London

June 11th: Interview at London Embassy - Approved :)

Yes I adjusted from a VWP.... I did have lots of proof of my intent to return to Scotland after my 10 week stay... I had just had major surgery and had check-up appointments with doctors, I owned my own house, I had a job and my car was sitting at glasgow airport long stay car park....

I was not asked at interview about my intent to remain... I am not sure if it was because we had filed all the proof with the AOS forms including copies of the legal papers giving my mother authority to sell my home and and car... and a copy of my letter to my employer resigning from my job...

Follow the guides at the top of the forum and if you feel you may have problems check it all out with a lawyer....

People like you are what makes it difficult for any tourist adjuster to get informed advice and respect.
I completely disagree. If you recall the history of this site an entire section concerning tourist adjustments was removed because of pressure from a particular attorney.

Getting stick about advising doing it is one thing. Getting stick because your circumstances are such that it is appropriate for you to do it is another entirely.

There are still people on here who WHENEVER it comes up suggest that it is illegal and morally bereft, and that's because of people who abuse the system - like having preconceived intent (wink wink).

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.

I agree with this part 100%. And it is shame these people attack a completely legal option as if we were discussing plans of digging under the border.

However, I also suspect that these people are mad because they had to wait in line, go through governmental bureaucracy, and be separated when they applied for a K1/K3/CRI/IR1 visa while someone else hopped on a plane and came here and went straight to simple AOS. Unfortunately these people fail to take into account the differences between everybody's individual circumstances as well as all the immigration benefits available.

As for people that abuse system, ignore them and don't lose any sleep over them. It is out of your control. But it does make for a good read.

I just can't believe it.

I believe the OP said "Met someone last december." But I am sure you don't view this as a coincidence in either case.

You really need to think first about living with your partner first to see if you have a viable relationship.... I can't procrastinate because I met my husband last august and after being critically ill in hospital, I had to stay in the US longer than planned and during that time we lived together. He proposed in October after I had been home in the uk for 2 weeks and I accepted and flew back to texas, but we lived together to see if we could actually get on together without killing one another before taking the step to marry.

Marriage is a life long committment and shouldn't be entered into lightly. Get over the honeymoon newness of your relationship, start paying bills together and running a house then decide whether or not marriage is the right thing to do...

I don't know if you really meant it when you said "WINK WINK" and if we all understood it as we should have... But lemme tell you one thing..

When i first did AOS, i came on this website to find people's stories. And at times, especially at the beginning, i was somewhat attacked as well because i got married as a visitor to the US, even though everything was done in a perfectly legal manner. I used to lose sleep over it and even sometimes get into arguments with my husband because of a few that scared me by telling me that i will have to prove that i was going to go back to CAnada, or else, i wouldn't ever be allowed to enter the US again! As time passed, and i started to learn more about immigration and all the legal terms, i realized that i was doing nothing wrong, that there are alot of people here in the same situation, and those that scared me are no experts at immigration issues. So if you need REAL advice, NOT JUST OPINIONS ALOT OF THE TIMES THAT WILL SCARE YOU, just get an immigration lawyer.

Use YOUR common sense, don't let others think for you. Take in what you think is right and try as much as you can to disregard what you think is wrong. And by the way, i'm not insulting you, but i will say that your wink wink comment was stupid.. Watch what you say. And as others have stated in other threads, IF you have a real marriage, don't worry. This is what kept me going.

YOu said you had a truck back in ur country. Can you not sell it urself or have someone sell it for you and send some proof that you sold it recently? Keep your ticket stating that you were going to go back to your country, because they will ask for it. If you were working there, maybe you can get your boss to write something stating that you were expected to show up at work..

It's not the real marriage part that is the problem, Nina. It's not even the marrying on a tourist visa.

It's the potential material misrepresentation at the POE which may be Ashwins undoing here, as alluded to by the "wink wink" comment made earlier.

Make sure you're wearing clean knickers. You never know when you'll be run over by a bus.
