Timeline

When my fiance arrives in the U.S. we will probably only have about 30 days left on our k-1. Should we apply for an extension so he can work while he is waiting for his EAD? We want to get married immediately, but then he can't work can he? I'm open to all suggestions

9/5/2004 met

7/4/2006 visited for 1 week in Russia (Independence Day!)

12/26/06 three week visit in the U.S.

4/6/07 He came to US for 6 glorious weeks

5/20/07 He returned to Ufa, RU

5/24/07 Mailed I-129F to NSC!!!!!

5/25/07 Received and signed for by F Heinauer, NSC

6/11/07 NOA1 (NEVER received hard copy)

8/23/07 Ramzis comes to America for another visit

10/02/07 Ramzis returns to Russia

11/06/07 NOA2 at LAST!!!

12/17/07 Received at NVC (at last!)

12/18/07 Sent to Moscow Embassy & New NVC Case Number

12/21/07 Received at 11:08 a.m. Moscow Embassy

1/25/08 Received packet from Embassy

03/07/08 Interview 8:00 a.m. Moscow Embassy! VISA APPROVED!!!

03/13/08 Visa in Hand

03/14/08 Flying to U.S. - Detroit POE

03/15/08 Our Wedding Day!

AOS Timeline

3/21/08 - Packet sent to Chicago Lockbox

3/24/08 - Packet received and signed for

3/28/08 - NOA1 received in the mail - EAD & AOS - check cashed

4/15/08 - Biometrics

5/5/08 - AOS interview notice received in the mail (will be in Detroit, June 12, 2008)

6/2/08 - EAD card ordered (CRIS email)

6/5/08 - EAD RECEIVED IN THE MAIL

6/12/08 - Permanent Resident APPROVAL! Green Card on the Way!

6/23/08 - Green Card Received!!!

Timeline

When your fiance arrives in the US he will ave 90 on his K1. Its valid for 6 months after approval and prior to entering the US. Upon arrival in US, you must then marry in 90 days. No extensions.

When you arrive in the US, the K-1 is valid for a 90 day stay. He can only work for 90 days with the EAD stamp, and JFK is the only airport that currently provides it.

K-1 is voided upon entry, the POE will issue and attach an I-94 card valid for 90 days, you need to marry inside the 90 days of the I-94 card, the K-1 expiration date is the last date you can enter the USA, and has nothing to do with the 90 days after entry that a marriage has to happen.

There is no extension required for the K-1.

When you arrive in the US, the K-1 is valid for a 90 day stay. He can only work for 90 days with the EAD stamp, and JFK is the only airport that currently provides it.

This discussion about needing EAD stamp came up earlier.

I am beginning to read the OVERWHELMING amount of information on acquiring a work permit. Is it true JFK is the only East coast airport that gives out a work permit? (We're coming in on a K-1). Does anybody know if they give them out at Detroit?

Does not matter you are allowed to work for 90 days after you arrive on K1 or up until marriage day, irregardless of whether they give you the stamp or not, we did it, no problems. After marriage you have to stop working and have a work permit EAD or green card to continue on working legally per US immigration laws.

You made me do some looking.

Read form I-9 directions particularly list A requirements;

5. An unexpired foreign passport with an unexpired Arrival-Departure Record, Form I-94, bearing the same name as the passport and containing an endorsement of the alien's nonimmigrant status, if that status authorizes the alien to work for the employer.

Sounds like if the employer is aware that K-1 is work authorized they can employ the person for the validity period of the I-94 card, 90 days from entry on the K-1, after that and EAD, Green-card or I-551 stamp is required to continue working.

The employ does not need to quit working after marriage, only after the I-94 expires, and it is te responsibility of the employer to ensure that the person is work authorized.

Of course anyone can work regardless of whether they are work authorized or not or whether they can prove they are work authorization or not. Secondly, marriage has nothing to do with the ending of the work authorization period.
