Name to use on I-130

My wife and I recently married. We are filling out the paperwork for AOS and are wondering if we can use her married name or need to use her maiden name. The marriage cetificate shows her last name. She is here on a tourist visa and arrived in June. This forum is a great asset, especially since we were quoted a price of $2500 to complete this paperwork!

Use her current legal name. If it changed at marriage, she's going to need a passport in the new name as well.

If she is planning on taking on your last name as her last name, then put the married name on the I-130 and I-485. The marriage license is the proof that she is married to you and can take on your last name if she wishes.

If you use her maiden name when filing and decide later to change it to her married name, it will cost a lot to get the name changed on her green card. So if she plans on using it now, then fill in all the documents with her married name.
