should I try for business visa to meet in person

My fiancee is in USA,we met online and we learned that quickest possible way is fiancee visa but we also learned that meeting in person is mandatory and its not possible for her to come to India for longer time(max.only for a week) because of job and other occupations.

In this case I think of trying to get business visa...asking a sponsor letter from her claiming that we want to establish business together ( and which is a fact...we also want to do business together)

I want to know if I apply for business visa (I get it or not)...will it effect our fiancee visa petition later?

will they consider it negatively for fiancee visa if I try for business visa now (before filing fiancee visa petition?)

I suggest she comes over for that week to India and you meet in person and see how it goes.

Sometimes things are different in real life than they are on the internet, see if there is a spark, if you think this is something you both want to go further with, especially something as serious as marriage. If it is, consider your options.

Having another type of visa shouldn't effect your K1 visa petition, a visitor visa for example is a great way for you to enter the U.S. and stay with her for awhile to get to really know her. Just make sure you don't get married while you are there and try to stay. Return back to India and do it the legal way with the K1 visa or if you do get married, go with the K3 or CR-1.

The visa for what you are proposing is called EB-5. However you would be required to create 10 jobs and invest $1,000,000 ($500,000 in certain areas) in a new business. Other work visas usually require an employer to sponsor you as an employee, not as a self-employed person.

No, he's talking about EB-5 if he says he wants to establish a business in the U.S. it's EB-5 if he was coming to attend a business related activity it would be B1. Read this:

Business/Tourist Visa(B1/B2) information

Business travelers who wish to visit the U.S. for a short period of time to conduct meetings, attend conferences, promote business development, or engage in other similar activities, should apply for a B-1 visa. Generally speaking, it is not permitted to work or seek employment while in the U.S. on a B-1 visa.

The B-2 visa is for foreign nationals seeking to enter the U.S. for a short time for the purposes of tourism, social visits, or other recreational activities.

Immigration through Investment: Permanent resident status based on EB-5 eligibility is available to investors, either alone or coming with their spouse and unmarried children. Eligible aliens are those who have invested -- or are actively in the process of investing -- the required amount of capital into a new commercial enterprise that they have established. They must further demonstrate that this investment will benefit the United States economy and create the requisite number of full-time jobs for qualified persons within the United States.

In general, "eligible individuals" include those:

1. Who establish a new commercial enterprise by:

  • creating an original business;
  • purchasing an existing business and simultaneously or subsequently restructuring or reorganizing the business such that a new commercial enterprise results; or
  • expanding an existing business by 140 percent of the pre-investment number of jobs or net worth, or retaining all existing jobs in a troubled business that has lost 20 percent of its net worth over the past 12 to 24 months; and
2. Who have invested -- or who are actively in the process of investing -- in a new commercial enterprise:
  • at least $1,000,000, or
  • at least $500,000 where the investment is being made in a "targeted employment area," which is an area that has experienced unemployment of at least 150 per cent of the national average rate or a rural area as designated by OMB; and
3. Whose engagement in a new commercial enterprise will benefit the United States economy and:
  • create full-time employment for not fewer than 10 qualified individuals; or
  • maintain the number of existing employees at no less than the pre-investment level for a period of at least two years, where the capital investment is being made in a "troubled business," which is a business that has been in existence for at least two years and that has lost 20 percent of its net worth over the past 12 to 24 months

OP, if you want to enter the U.S. as an investor, you'll need to meet the requirements for EB-5...unless you have the money to do it, that is the most difficult way to go visit your fiance. Also, please note that this type of visa( EB-5) is to seek a resident status.

Appliying for a work-based visa as a temporary worker wont be easy either, unless you already have an american company who is willing to be your sponsor.

Why doesnt your fiance come and visit you? Its far easier this way and saves all the complexities of trying to get into the US for a visit if all you're trying to establish is that you have met in person.
